These transformers are classified as non-PCB per 40 CFR 761 due to: 1. Where analysis was performed, results
show <50 PPM PCB, or 2. where analysis was not performed, manufacture data plates show non-PCB. The
purchaser will not be authorized to utilize a Statement of Intent (SOI) destination in a state which regulates PCB
levels at a more stringent level than 40 CFR 761 unless the transformer PCBs levels are under the state regulated
level. Example: CA, OR, and WA regulate PCBs if >5 PPM. SOI destinations in these states can receive
transformers from these sales if the transformer PCBs levels are less than 5 PPM.
These transformers are intact and unbroken. Should a leak be found at time removal, the Generator will fix the
leak. Once leak has been verified fixed by Purchaser and Generator, only then can the transformer be
removed by Purchaser.
Potential high bidders that list a SOI destination in these states will not be considered responsive bidders and their
bids will be rejected. Also, Intent to export these transformers outside of the US for recycling is not authorized under
this sale. Potential high bidders intending to recycle the transformers outside of the US will not be considered
responsive bidders and their bids will be rejected.
