Justification for Sole Source
This procurement was conducted as a sole source award under the authority of FAR 13.201-1, citing only one responsible source. The justification stems from the proprietary nature of the existing Cleaver Brooks boilers, manufactured by Preferred Utilities Manufacturing Corporation. The manufacturer only permits their designated vendor, Simoneau Sterling Midwest Corp (for the Midwest region including Minnesota), to provide compatible supplies and installation services. Market research, including a search of 145 SDVOSB and 160 VOSB entities under NAICS 334512, did not identify any other authorized providers. A sources sought notice was issued, and only Simoneau Sterling Midwest Corp responded. Neither the VA Rule of Two nor the SBA Rule of Two could be met.
Place of Performance
