Sole Source Justification

This document is a sole source justification for the brand name only purchase of Steris HarmonyAIR ALYON dual and triple ceiling mounted surgical lights, along with associated accessories, delivery, installation, deinstallation, disposal, and training services. The Margaret Cochran Corbin VA Medical Center requires these systems to replace aging operating room (OR) lights that are past their recommended replacement date and are beyond economical repair. The new lighting systems are intended to improve surgical visibility, enhance patient safety, enable modern imaging compatibility, and support advanced procedural workflows.

• Associated drop tubes, ceiling plates, wall control boxes

• Deinstallation of existing lights

• Installation of new lights

• Project Design, Program Planning & Coordination Support

• Customer requested delivery to inside of building

• The procurement will be awarded as a new contract with a firm-fixed price.

• This justification is for a sole source procurement under simplified procedures (RFO FAR 12).

• The authority cited is 41 U.S.C. § 1901, implemented by RFO FAR 12.201-1, due to the unique qualifications and nature of the acquisition.

• Market research was conducted, including searches on SBA, SAM.gov/contracting (FPDS), ADDS UP, and GSA. A previous similar contract (VA Contract 36C24920N0592) was identified.

• The agency reached out to the OEM, Steris Corporation, for a list of authorized distributors.

• A solicitation (36C24226Q0511) was posted to SAM.gov, but the only offer received from Buffalo Supply Inc. was deemed technically unacceptable due to non-compliance with mandatory clauses.

• The procurement is being solicited as unrestricted on the open market to ensure a technically acceptable offer.

• The justification for sole source is based on the Steris HarmonyAIR ALYON system being the only light on the market with specific features such as four adjustable pattern size options, built-in obstruction detection, and a CRI of 98, which are required by the station.

• The current ceiling-mounted surgical OR light fleet is past its recommended replacement date.

• The agency intends to remove or overcome barriers to competition for future acquisitions by confirming the list of authorized distributors with the OEM.

This document is the "Buy American Certificate" provision (FAR 52.225-2, Oct 2022). It requires offerors to certify the domestic content of end products and identify any domestic end products containing a critical component.

• Certification: Offerors must certify that each end product is a domestic end product, unless listed as a foreign end product.
• Foreign End Products: Offerors must list foreign end products, their country of origin, and indicate if they exceed 55% domestic content (unless COTS or unknown).
• Domestic End Products with Critical Components: Offerors must separately list the line item numbers of domestic end products that contain a critical component.
• Definitions: Key terms such as "domestic end product," "foreign end product," and "critical component" are defined within the solicitation clause "Buy American-Supplies."

This certificate is a mandatory part of the offer. Bidders must accurately complete this form to comply with the Buy American Act requirements, which will be used by the Government to evaluate offers in accordance with FAR Part 25.

Solicitation / RFP / RFQ

This is a combined synopsis/solicitation for the brand name only purchase of Steris HarmonyAIR ALYON Operating Room Lighting System for the Margaret Cochran Corbin VA Medical Center. The current OR light fleet is past its recommended replacement date and requires replacement. The procurement is being conducted in accordance with FAR Part 12 procedures for commercial products and services.

• Six (6) Steris Harmony Air ALYON dual ceiling mounted surgical lights with associated drop tubes, ceiling plates, and wall control boxes.

• Two (2) Steris Harmony Air ALYON triple ceiling mounted surgical lights with associated accessories.

• Deinstallation of existing OR lights.

• Installation of new Harmony Light systems.

• Disposal of removed OR lights.

• Delivery of equipment.

• Clinical and technical training services.

• Project Design, Program Planning & Coordination Support Services.

• White glove delivery to inside of building.

• Delivery shall be provided no later than 180 days after award.

• Contractor shall provide a one-year equipment warranty.

• Installation to be completed within 2 months of equipment delivery.

• Onsite training to be provided within 1 month of completed equipment installation.

• Evaluation: Award will be based on a comparative evaluation of quotes considering Technical Capability and Price.

• Technical Capability: Offeror must demonstrate the capability to meet all requirements and be authorized to provide the equipment.

• Price: Total of all line-item prices.

• Offerors must include a statement regarding acceptance of terms and conditions or list any exceptions.

• Set-Aside: Unrestricted.

• NAICS Code: 339113 (Surgical Appliance and Supplies Manufacturing) with a small business size standard of 800 Employees.

• Product Service Code (PSC): 6515 (Medical and Surgical Instruments, Equipment, and Supplies).

• Offerors must be registered in the System for Award Management (SAM).

• Submission of the FAR 52.225-2 Buy American Certificate is required.

• This solicitation is issued as an RFQ (Request for Quotation).

• No written solicitation document will be issued; this announcement is the only solicitation.

• Relevant FAR and VAAR clauses are incorporated by reference. Bidders can access them online.
