Sole Source Justification

This document justifies a sole source acquisition for the NanoKnife 3.0 Irreversible Electroporation (IRE) device. The West Haven VAMC requires a replacement for its current NanoKnife System 2.2.1, which has reached its end of life and is no longer supported by the Original Equipment Manufacturer (OEM), Angiodynamics. The current device's malfunctioning poses increasing danger.

• Procurement of a new NanoKnife 3.0 IRE device.

• The device uses a non-thermal method (IRE) to ablate tumor cells while preserving surrounding healthy tissue, making it suitable for tumors near vital structures.

• The current device is past its End of Life (EOL) and requires expedited replacement due to safety concerns.

• The acquisition is conducted under the Multiple-Award Schedule Program.

• The estimated value of the proposed action is $433,417.09.

• The proposed contractor is Marathon Medical Corp, identified as the Sole Authorized SDVOSB Distributor for AngioDynamics products.

• This is a sole source justification, not a solicitation requiring proposals.

• The justification cites "urgent and compelling need" and "items peculiar to one manufacturer" as reasons for sole source acquisition.

• Market research confirmed Marathon Medical Corp is the sole reseller for AngioDynamics products to the VA.

This is a Notice of Intent to Sole Source for a NanoKnife 3.0 Irreversible Electroporation (IRE) System. The Department of Veterans Affairs, VISN 1, VA Connecticut Healthcare, West Haven VAMC intends to award a firm-fixed contract to Marathon Medical Corporation for this system.

• Contract type: Firm-fixed contract.

• This is NOT a Request for Competitive Proposals. There is no solicitation available at this time.

• Requests for a solicitation will not receive a response.

• All responsible sources that feel they should be considered qualified to provide the products may submit a response to this notice by the response due date.

• The information provided shall include detailed and relevant documentation to allow the government to perform adequate market research and make a proper determination.

• A determination by the government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government.

• Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.

• The proposed procurement is for products and services for which the Government intends to solicit and negotiate with only one source under the authority of Soliciting from a Single Source using GSAM/R 538.7104-3(b).
