• The statutory authority used is 38 U.S.C. § 8127(c), allowing sole-source awards to eligible SDVOSB or VOSB concerns.

• Heidelberg Engineering GmbH is the sole manufacturer of the Spectralis system.

• Heidelberg Engineering, Inc. (U.S. subsidiary) has identified L1 Enterprises, Inc. as the only authorized distributor for U.S. Government accounts.

• L1 Enterprises, Inc. is the only responsible and authorized source capable of providing the required equipment and services.

• Market research confirmed the OEM's confirmation of a single authorized SDVOSB distributor and verified L1 Enterprises, Inc.'s SDVOSB status.

Intent to Sole Source

This document is a Notice of Intent to Sole Source for the procurement of a Spectralis Tracking OCT (Optical Coherence Tomography) System, including OCT Plus w/OCT2 MultiColor, for the James A. Haley Veterans’ Hospital (JAHVH) Ophthalmology Clinic. The Department of Veterans Affairs, VISN 08, requires this equipment to replace outdated OCT units that no longer meet operational standards, ensuring high-resolution diagnostic imaging for Veteran patient care.

The acquisition is being conducted under the authority of FAR 6.302-1, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements." Market research indicates that Heidelberg Engineering GmbH is the sole manufacturer of the Spectralis OCT system. Heidelberg Engineering, Inc. is the exclusive U.S. distributor, and L1 Enterprises, Inc. is the only authorized distributor for U.S. Government customers.

Due to these exclusive arrangements, L1 Enterprises, Inc. is identified as the only responsible source capable of supplying the required equipment and associated services in accordance with OEM specifications and Government procurement requirements.

A Notice of Intent to Sole Source will be posted on Contracting Opportunities to allow any potential vendors to express interest or demonstrate their capability to meet the requirement. If no other responsible sources come forward with documentation demonstrating authorized capability, the Government intends to proceed with a sole-source award to L1 Enterprises, Inc.
