Solicitation / RFP / RFQ

This document is a combined synopsis/solicitation for commercial items, specifically a request for quote (RFQ) to procure a "Motor Grader." The acquisition is being conducted in accordance with FAR Part 12 (Commercial Items) and FAR Part 13 (Simplified Acquisition Procedures).

• Item: 1 each of a 6 Wheel Drive Motor Grader.

• Product/Service Code: 3805 (Earth Moving and Excavating Equipment).

• Specifications: Must meet or exceed specifications detailed in an attached specification document.

• Brand Name or Equal: The requirement is for a "Brand Name or Equal" product. Offers must meet the salient physical, functional, and performance characteristics of the Original Equipment Manufacturer (OEM) product.

• Delivery: Within 60 days after award.

• Contract Type: A single Firm Fixed Priced Purchase Order is anticipated.

• Period of Performance: Delivery within 60 days after award.

• Pricing: The quote must be all-inclusive of all costs to complete the requirement, including taxes, labor, supervision, equipment, materials, travel, permits, and any other pertinent costs. Taxes are included in the contract price per FAR 52.212-4(k).

• Submission Method: Quotes must be submitted via electronic mail to melanie.schiaveto@bia.gov.

• Quote Due Date: No later than 5:00 pm Pacific Daylight Time on March 10, 2026.

• Quote Content: Must include product specifications/drawings, proof of authorized distributor/reseller status (if applicable), confirmation that items are fully manufactured and in stock, and lead times for delivery. Pricing must be a firm fixed price and all-inclusive.

• Evaluation Factors: Offers will be evaluated based on Technical Acceptability (conformance to specifications, capability to meet delivery timeframe, proof of stock/reseller status) and Price (reasonableness, including delivery costs).

• NAICS Code: 333120 - Construction Machinery Manufacturing.

• Size Standard: 1250 Employees.

• Set Aside: This acquisition is set aside exclusively for Indian Small Business Economic Enterprises (ISBEE).

• Buy Indian Act: Offers are solicited only from Indian Economic Enterprises that are also small business concerns. Offers not meeting both criteria will be rejected.

• The place of performance is Uintah & Ouray Agency, Ft. Duchesne, Utah.

• Prospective contractors are advised to review sections E (Instructions to Offerors) and 52.212-1 and 52.212-2 (Evaluation) in their entirety.

• Numerous FAR clauses are incorporated by reference and/or full text, covering various aspects of contract terms, conditions, representations, and certifications.

Statement of Work (SOW)

To procure one Motor Grader for road maintenance operations at the Uintah & Ouray Agency.

• One Motor Grader with 6 Wheel Drive, 14 Foot Moldboard, and 17.5 R25 tires.

• The supplier/contractor will deliver the Motor Grader to or near the U&O Agency.

• The Motor Grader must be supplied in operable condition by the specified award date.

• The Motor Grader must meet the attached specifications, with John Deere 672G preferred.

• Delivery or pick-up near the destination is required.

• The equipment will be fully assembled and functional.

• Operation training, operating manuals, and warranty materials will be provided.

• All dimensions will closely match the attached specifications; nominal differences are acceptable.

• Delivery to the Uintah & Ouray Agency, located in Ft. Duchesne, Utah.

Form / Attachment

This document is the "Indian Affairs Indian Economic Enterprise Representation Form." Its purpose is for offerors to self-certify that they meet the definition of an "Indian Economic Enterprise (IEE)" as defined in the Buy Indian Act (25 U.S.C. 47) and Department of the Interior Acquisition Regulation (DIAR) Part 1480. This form is used to represent IEE status for opportunities set aside under the Buy Indian Act.

• Self-Certification: The form serves as a self-certification of IEE status by the offeror's signature.
• Eligibility Requirements: The enterprise must meet IEE requirements at three critical times:
  • When an offer is made in response to a written solicitation.
  • At the time of contract award.
  • During the full term of the contract.
• Information Fields: Bidders must provide:
  • Solicitation/Sources Sought/RFI Number
  • Project Title
  • Date of Form Submission
  • Name of Federally Recognized Tribal Entity
  • Name of the 51% (or greater) Owner of the IEE Firm
  • Legal Business Name
  • Certifying Signature
  • Unique Entity ID (UEI)
  • Printed Name
• Verification: Contracting Officers may request additional documentation of eligibility at any point in the acquisition lifecycle.
• Penalties: Submitting false or misleading information is a violation of law and subject to penalties under 18 U.S.C. 1001, 31 U.S.C. 3729 to 3731, and 18 U.S.C. 287.

This form is essential for bidders who intend to compete for contracts designated for Indian Economic Enterprises under the Buy Indian Act. Completing and submitting this form accurately is a prerequisite for demonstrating eligibility.
