Sole Source Justification & Response
The Government intends to solicit and negotiate with only one responsible source, THE BOEING COMPANY, under the authority of 10 U.S.C. 2304(c)(1), as supplemented by FAR 6.302. This is due to the OEM status and lack of Government data rights. All responsible sources may submit a capability statement, proposal, or quotation. Information received will be considered for determining whether to conduct a competitive procurement.
- Commercial Item Interest: Interested persons may identify their interest and capability to satisfy the requirement with a commercial item within 15 days of this notice (by April 15, 2026).
- Proposals for Competitive Procurement: Proposals received within 45 days after the publication date (by May 15, 2026) will be considered.
- Source Approval Request (SAR): Firms not already approved to manufacture this material must submit a SAR. However, this procurement will not be delayed for SAR approval.
Additional Notes
This acquisition will use provisions, clauses, and procedures prescribed in FAR Part 15. The Government is not using FAR Part 12 (Acquisition of Commercial Items). UID requirements and Buy American Clauses will apply. Electronic procedures will be used, and the RFP will be posted to NECO. No telephone requests will be honored.
