This document contains responses to vendor questions regarding a potential requirement for investigative services, including surveillance and open-source intelligence.

• Scope Flexibility: The Bureau may consider responses for specific portions of the scope (e.g., Social Media Monitoring) but prefers a vendor capable of providing all aspects of the requirement, including physical surveillance.

• Procurement Timeline: The re-compete is considered a new requirement, and the release timeline on SAM.gov or other platforms is undetermined, pending RFI results.

• Incumbent Information: There is no current incumbent for this requirement, and therefore, no contract value or period of performance to share.

• Period of Performance: The anticipated period of performance is a one-year base period with four one-year option periods, totaling five years. Individual task orders are expected to range from 30 to 90 days.

• Place of Performance: Work will primarily be performed at contractor facilities, with travel to various locations as needed. Investigations may occur nationwide, including U.S. territories.

• Labor Categories: Anticipated labor categories include Junior, Mid-Level, and Senior Investigator, Surveillance Specialist, Case Analyst, Field Operations Manager, and Administrative Support. Personnel must meet state licensing requirements.

• Investigation Volume & Timeframes: An average of 30 new investigations per month is anticipated, with completion times of 30-60 days per investigation, depending on complexity.

• Surveillance Requirement: 60-70% of cases may involve surveillance activities, but this will vary by case.

• OSINT Performance: Open-Source Intelligence activities can be performed at contractor facilities, provided security and data protection requirements are met.

• Reporting: Interim monitoring reports and observation logs are required weekly during active surveillance, with a comprehensive final report upon case completion.

• The determination of whether the RFP will be a small business set-aside will be made after reviewing RFI information.

• Any considerations regarding direct contracting will be addressed in the formal solicitation.

Request for Information (RFI)

This RFI seeks information from qualified vendors capable of providing professional administrative investigation services to support the Federal Bureau of Prisons (BOP) in reviewing active workers' compensation claims. The goal is to identify potential fraud or inconsistencies by gathering evidence that may contradict an employee's reported medical restrictions. The acquisition falls under NAICS Code 561611 – Investigation Services.

• Social Media Monitoring and Open-Source Intelligence (OSINT): Identify claimant profiles, establish monitoring parameters, conduct systematic reviews of public social media content, and capture/document content that may contradict reported functional limitations.

• Lawful Surveillance and Observation: Plan and conduct observations in public locations, document observed events, capture photographic/video evidence with metadata, and maintain chain of custody for all collected evidence.

• Vendors must comply with all applicable BOP policies and federal regulations governing workers' compensation investigations, privacy, and evidence handling (e.g., BOP Program Statements 1601.04, 1351.05, 1210.24, 1210.25, and 3420.012).

• Investigative practices must adhere to privacy laws, evidentiary standards, and applicable statutes.

• Contractors shall not trespass or utilize hidden recording devices in non-public spaces.

Interested vendors should provide:

• Company name, UEI, and SAM.gov registration status.
• Business size under NAICS 561611.
• Relevant past performance with federal/government agencies.
• Description of investigative methodologies for social media monitoring and surveillance.
• Description of chain-of-custody procedures and evidence integrity safeguards.
• Confirmation of compliance with Privacy Act and federal evidentiary standards.
• Description of personnel qualifications and licensing (if applicable).
• Confirmation of nationwide coverage capability.
