Justification & Evaluation
The Government intends to procure these items under the statutory authority of 10 U.S.C. Section 3204(a)(1), as implemented by FAR 6.302-1, "Only one responsible source and no other supplies or services will satisfy agency requirements." King Nutronics Corporation is identified as the Original Equipment Manufacturer (OEM) and the exclusive data right holder for this proprietary system, making them the only vendor capable of meeting the Government's requirements.
This notification is not a request for competitive proposals. However, all responses received within fifteen (15) days of publication will be considered by the Government to determine if competition is feasible. A decision not to open the requirement to competition based on responses is solely at the Government's discretion.
