1. Description of Requirement:

The National Guard USPFO PR P&C has awarded a sole source contract for a code and criteria review of plans and specifications for Puerto Rico Army National Guard Project No. 431850, Engineering-Housing Maintenance Shop (DPW) at Camp Santiago Joint Training Center (CSJTC), Salinas, Puerto Rico.

2. Basis for Sole Source Award:

This award is made under the authority of Federal Acquisition Regulation (FAR) 6.302-1(a), “Only One Responsible Source.” The Government determined that CH2M HILL-HDR JV is the only responsible source capable of performing this work without substantial duplication of cost and unacceptable delays. This determination was based on the following factors:

a) Designer of Record: CH2M HILL-HDR JV is the Architect-Engineer firm that originally prepared the design plans and specifications and remains the Designer of Record for this project. 

b) Performance & Liability Risk: Transferring the code and criteria review to another firm introduces significant performance and liability risks. FAR 52.236-23 assigns liability to the Architect-Engineer Contractor and Designer of Record, with joint and several liability for all entities involved.

c) Maintaining Professional Responsibility: Potential updates to plans and specifications due to changing codes and regulations must be performed by the original A-E Contractor and Designer of Record to maintain professional A-E responsibility.

d) Intimate Knowledge: CH2M HILL-HDR JV possesses intimate knowledge of design, crucial for a thorough and accurate code and criteria review.

A Notice of Intent was previously published on SAM.gov from 28 July 2025 through 11 August 2025 under Notice ID PANNGB-25-P-0000009399 "Notice of Intent to Sole Source Architect/Engineer (A/E) Services to Perform a Code and Criteria Review on Design Documents by the Designer of Record". No responses were received that demonstrated a viable competitive alternative.
