The Detroit VA Medical Center (VAMC) requires Phigenics Continuous Water Monitoring Services and System Maintenance & Repairs.

Network Contracting Office (NCO) 10 intends to issue a sole-source solicitation to Phigenics, LLC, 3S701 West Avenue, Warrenville, IL 60555, for patented water monitoring services and maintenance and repair of the multiple Phigenics monitoring and disinfection systems. Phigenics is the Original Equipment Manufacturer (OEM) and sole proprietor for Phigenics equipment and services under this requirement.

Per Phigenics proprietary letter, Phigenics is the sole proprietor for the Potable Water Analytics systems as well as the web-based data management system phiMetrics, and is exclusively authorized to repair/maintain/service the following equipment and associated services:

Phigenics Validation Test (PVT) Legionella and Total Heterotrophic Aerobic Bacteria (THAB) both use our patented TimeZero test method for quantitative measurement of viable Legionella and total heterotrophic aerobic bacteria. The uses, compositions and methods for both testing products are registered in three U.S. Patents: USPTO Nos. 7,939,314; 7,935,521; and 7,901,932.

This procurement, therefore, is being conducted in accordance with FAR 6.302-1(a)(2), only one responsible source and no other supplies or services will satisfy agency requirements. The NAICS code for this procurement is 541380, and the Small Business Administration Size Standard is $19.0 Million.

This Notice of Intent is not a request for competitive quotes. No solicitation document is available and telephone requests will not be accepted. However, any responsible source who believes it is capable of fully meeting the requirements may submit a quote, which may be considered by the agency, only if received by the closing date and time of this notice. Any response to this notice must show clear and convincing evidence that the responding company can meet the requirements of the Government. Responses received will be evaluated; however, a determination by the Government not to compete the proposed procurement based upon responses received to this notice is solely within the discretion of the Government.
