Limitations on Subcontracting
A key consideration is FAR 52.52.219-14 Limitations on Subcontracting (CLASS DEVIATION 2021-O0008), which states that offerors cannot pay more than 50% of contract performance to non-similarly situated entities. Given that most RCRA Treatment, Storage, Disposal Facilities (TSDFs) are large businesses, respondents must explain how they would comply with this requirement. Firms unable to meet this limitation may still express interest via email without a full capabilities package.
Submission Requirements
Interested firms must submit a brief capabilities package (max three pages, single-spaced, 12-point font) via email to Ashley.Krawczyk-Bowers@dla.mil with the subject line "SOURCES SOUGHT HAZ WASTE Bavaria Hazardous Waste". The package must include:
- Company name, office location(s), CAGE Code, and small business classification status.
- Relevant experience within the last five years, including contract numbers and points of contact.
- A statement detailing the firm's ability to perform in accordance with FAR 52.219-14 Limitations on Subcontracting, explaining compliance (not required for large businesses).
- A listing of proposed TSDFs, identifying each as similarly situated or not.
