Quick Summary
The Department of Defense (DoD), specifically the Defense Information Systems Agency (DISA), has issued a Brand-Name Class Justification and Approval (J&A) for Hardware Renewal Warranty Support and Maintenance. This J&A allows for an exception to fair opportunity under FAR Subpart 16.5 to procure support for previously purchased proprietary, commercial off-the-shelf, brand-name hardware already integrated within existing mission partner infrastructure. The J&A covers a five-year period, estimated from April 1, 2026, through March 31, 2031.
Purpose & Scope
This Class J&A's purpose is to secure annual hardware renewal warranty support and maintenance for existing proprietary, brand-name hardware. This includes product upgrades, new releases, versions, fixes, and patches. The scope is strictly limited to hardware support and maintenance and does not cover the procurement of new hardware. The justification is based on the essential nature of specific brand-name products and market research indicating that other companies' similar products do not meet agency needs.
Contract Details
Individual procurements under this J&A will be awarded as firm-fixed-price contracts or delivery orders. Potential contract vehicles include NASA SEWP, Army CHESS, GSA Federal Supply Schedules (FSS), or the open market via SAM.gov. The total estimated price for proposed acquisitions will be based on tracking actual usage from a predecessor J&A. Orders issued during the covered period may include option periods and can be in effect longer than the J&A's duration.
Set-Aside & Eligibility
Market research findings regarding small business set-asides will be coordinated through the DISA Office of Small Business Programs.
Submission & Evaluation
Individual requirements will be competed among authorized resellers via NASA SEWP, Army CHESS, GSA Schedules, GSA BPAs, and SAM.gov. Price reasonableness will be determined at the individual contract or order level, based on competitive quotes, historical prices, commercial price lists, and independent government cost estimates.
Additional Notes
This J&A references statutory authorities including 10 U.S.C. 3406(c)(5), FAR 16.505(a)(4), FAR 8.405-6(b)(1), and FAR 6.302-1/DFARS 206.302-1. Questions should be directed to Matthew Cassady (matthew.r.cassady2.civ@mail.mil).
