This acquisition is an Indian-owned, Small-Business, Economic Enterprise (ISBEE) set aside. The contract type, period of performance, and estimated value are not specified in this document.

• Quotes are requested. A separate written solicitation will not be issued.
• The evaluation factor is Lowest Price Technically Acceptable (LPTA).

This document is the "Indian Health Service Buy Indian Act Indian Economic Enterprise Representation Form." It is used by offerors to self-certify that they meet the definition of an "Indian Economic Enterprise" (IEE) in accordance with the Buy Indian Act (25 U.S.C. 47). This self-certification is required in response to Sources Sought Notices, Requests for Information (RFIs), or Solicitations.

• Eligibility Requirement: Offerors must meet the definition of an IEE throughout the solicitation response period, contract award, and the entire contract performance period.
• Notification: Contractors must immediately notify the Contracting Officer if they no longer meet eligibility requirements.
• Documentation: Contracting Officers may require documentation of eligibility before awarding Buy Indian Act set-aside or sole source contracts.
• Registration: Successful Offerors must be registered with the System of Award Management (SAM).
• Penalties: False or misleading information is punishable under federal law.
• Representation: Offerors must indicate whether they represent that their offer does or does not meet the definition of an IEE with "Indian Ownership."
• Required Information: The form requires the Offeror to provide:
  • Name of Federally Recognized Tribal Entity (if applicable)
  • Name of the 51% owner of IEE Firm
  • Business Name
  • Certifying Signature
  • UEI Number
  • Print Name

This form is critical for bidders responding to opportunities that are set aside or sole-sourced under the Buy Indian Act. Bidders must accurately complete and submit this form to self-certify their eligibility as an Indian Economic Enterprise. Failure to meet the criteria or accurately complete the form may impact their ability to be considered for or awarded the contract.
