Solicitation / RFP / RFQ

This is a combined synopsis/solicitation (RFQ) for commercial items, specifically for the procurement of two (2) bucket trucks on behalf of the Customs and Border Patrol. The General Services Administration (GSA) is issuing this RFQ.

• Procurement of two (2) bucket trucks.

• Pricing must be FOB Destination.

• Vendors must bid on the entire quantity of any selected line item; partial quantities will not be accepted.

• The government intends to award firm-fixed-price delivery order(s) as a result of this solicitation, specifically Motor Vehicle Delivery Order (MVDO).

• The government reserves the right to make one single award or multiple awards.

• Delivery dates are a significant evaluation factor.

• Quote Due Date: April 6, 2026, 9:00 AM EST.

• Respondent Questions Due: April 3, 2026, 3 PM EST.

• Quotes must be submitted via email to April Stanch (April.Stanch@gsa.gov) and Ed Hodges (John.Hodges@gsa.gov).

• Evaluation factors include: Technical Compliance (including delivery terms and dates), Past Performance, and Price. Technical compliance, delivery dates, and past performance combined will be weighed equally against price.

• A minimum of 2 and a maximum of 3 recent (within the last two years) and relevant past performance references are required.

• Technical submissions are limited to 20 pages; Past Performance to 3 pages; and Price to 1 page.

• This requirement is a 100% small business set-aside.

• Entities must have an active registration in SAM.gov to be considered.

• All required documentation, including SF 18, Attachment A (Price/Delivery Schedule), and Attachment B (Specifications), must be completed and submitted.

• Vendors must acknowledge all solicitation amendments.

• The Contracting Officer (CO) is the only person authorized to approve changes or modify requirements.

Amendment / Modification

This document is an addendum to FAR 52.212-4, "Contract Terms and Conditions—Commercial Products and Commercial Services." It modifies specific clauses within that FAR section, primarily concerning commercial supplier agreements.

• Payment Terms (g)(2): Clarifies the invoice payment due date, making it the later of 10 days after invoice receipt or 10 days after Government acceptance of supplies/services.

• Unauthorized Obligations (u): States that any language in a commercial supplier agreement requiring the Government to pay future fees, penalties, interest, legal costs, or indemnify the Contractor, which would create an Anti-Deficiency Act violation, is unenforceable against the Government.
• Commercial Supplier Agreements - Unenforceable Clauses (w): This is a significant modification. It dictates how commercial supplier agreements are treated when acquired under a Government contract. It specifies that:
  • The Government is not bound by "I agree" click-box or "browse-wrap" agreements.
  • Any language subjecting the U.S. Government to state/foreign laws or specific dispute resolution forums/timelines is deleted and replaced by Federal law.
  • The supplier cannot unilaterally revoke rights granted to the Government.
  • Indemnification clauses are amended to state that the U.S. Department of Justice has the sole right to represent the U.S. in such actions.
  • Audit clauses are modified to clarify that audits requested by the contractor are at the contractor's expense, and any resulting invoices must comply with contract invoicing requirements and are subject to dispute resolution.
  • Taxes or surcharges passed to the Government are governed by the contract and require Contracting Officer determination.
  • Assignment and delegation are prohibited without prior Government approval.
  • Confidentiality clauses are amended to clarify that the agreement itself is not confidential information, and "unit pricing" issues are resolved under the Freedom of Information Act. The Government may retain confidential information as required by law.

This addendum directly modifies FAR Clause 52.212-4, specifically paragraphs (g)(2), (s), (u), and introduces extensive modifications to paragraph (w) concerning commercial supplier agreements.
