Terms and Conditions

This document outlines the "Terms and Conditions" applicable to the solicitation 70Z03826QB0000107. It details various provisions and clauses that will govern any order awarded as a result of this solicitation, superseding all other terms and conditions.

• 52.212-1 Instructions to Offerors: Requires offerors to complete the "Requirement" document (Attachment 1) with unit prices. The period for acceptance of offers is to be held firm for 60 calendar days.
• 52.212-2 Evaluation: This provision is not applicable. Instead, quotes will be evaluated based on Federal Acquisition Regulation (FAR) 12 criteria, with award made to the lowest priced offeror rated technically acceptable.
  • Evaluation Method: Only the lowest priced offer will be evaluated for Technical Acceptability. If unacceptable, the process continues to the next lowest priced offer.
  • Technical Acceptability: Evaluated as "acceptable" or "unacceptable" based on the offeror's ability to provide new manufactured commercial items from the Original Equipment Manufacturer (OEM) or an OEM-approved source, and exact part numbers listed on the requirements schedule.
• Pricing: Offerors must provide pricing using the "Requirements – 70Z03826QB0000107" Excel sheet. Prices will be evaluated for fairness and reasonableness. Quantity discounts and prompt payment discounts should be included.
• 52.209-5 Certification Regarding Responsibility Matters: Requires certification regarding debarment, suspension, convictions, and delinquent Federal taxes.
• 52.209-11 Representation by Corporations Regarding Delinquent Tax Liability or Felony Conviction: Requires representation concerning unpaid Federal tax liability or felony convictions.
• 52.240-90 Security Prohibitions and Exclusions: Includes definitions and representations related to covered telecommunications equipment, services, and business operations in certain countries.
• Quality Assurance: Applicable to orders for products that will touch USCG aircraft. Requires immediate notification of any event, supply change, material change, malfunction, counterfeit/suspect parts, or defect that could cause non-conformity. The contractor's quality control manual must address risk management, testing, inspection, and counterfeit/suspect parts processes. Changes impacting the product must be immediately notified.
• Packaging and Marking Instructions: Specific requirements for packaging material, labeling, and marking of shipping containers.
• Shipping Instructions: Deliverable items are to be shipped to the USCG Aviation Logistics Center.
• Inspection and Acceptance: Performed at destination by local USCG personnel. A Certificate of Conformance (COC) is required for all items, signed by an authorized official and reflecting unbroken history of ownership. Full and clear traceability is mandatory.
• Option for Increased Quantity (52.217-6): For Line Item 1, the Government may increase the quantity by up to 15 units, with a maximum option of 30 units, within one calendar year of award.
• Sustainable Products and Services (52.223-23): Requires compliance with various statutory mandates and directives for purchasing sustainable products and services, including those related to recovered materials, energy efficiency, and biobased products.

Numerous FAR and HSAR clauses are incorporated by reference, covering areas such as:

• Contract terms and conditions for commercial products and services.
• Small business concerns and subcontracting.
• Labor standards and employment reports.
• Buy American and Trade Agreements.
• Security prohibitions and exclusions.
• Prohibitions on providing or using specific products or services, including those related to covered telecommunications equipment and certain foreign entities.
• Quality assurance and inspection.
• Payment and invoicing instructions.
• Contract termination.
