This document, "Attachment 2 - Applicable Provisions and Clauses," outlines the solicitation provisions and contract clauses that are incorporated by reference into the solicitation or resulting contract. Bidders are cautioned that some provisions may require completion and submission with their offer.

• Solicitation Provisions Incorporated by Reference (FAR 52.252-1): Notifies offerors that provisions are included by reference and that full text is available upon request. Offerors may need to complete and submit certain blocks within these provisions.
• Clauses Incorporated by Reference (FAR 52.252-2): Notifies that contract clauses are incorporated by reference. Full text is available upon request.
• List of Incorporated Provisions and Clauses: A comprehensive list of FAR and agency-specific (NIST) provisions and clauses, many of which are subject to January 2026 deviations. Key provisions include those related to System for Award Management (SAM), Buy American, Prohibition on Contracting with Inverted Domestic Corporations, and various compliance and representation requirements.
• Full Text Clauses: Provides the full text for FAR 52.212-4 (Terms and Conditions—Commercial Products and Commercial Services) and FAR 52.225-2 (Buy American Certificate), among others.

This document is critical for bidders to understand the legal framework, compliance requirements, and contractual obligations associated with the opportunity. Bidders must review the listed provisions and clauses, particularly those requiring action or representation (e.g., SAM registration, Buy American certification, representations regarding foreign telecommunications equipment, Sudan/Iran restrictions), to ensure their offer is compliant and to accurately assess their ability to meet the contract's terms. The inclusion of deviations and agency-specific clauses highlights specific areas of focus for this procurement.

Statement of Work (SOW) / Performance Work Statement (PWS)

The National Institute of Standards and Technology (NIST) Infrastructure and Materials Group requires a Data Acquisition (DAQ) system to support the CHIPS Metrology program. The system will collect in-situ resistance-based measurements for advanced test vehicles during accelerated aging experiments to study the long-term reliability of materials used in semiconductor chip packaging.

• Acquisition of a new DAQ system capable of measuring resistance and resistance-based temperature changes.

• The system will monitor 300-400 wires per sample, with measurements not exceeding 5V.

• Required to support a minimum of 125 4-wire channels (accommodating at least 500 wires).

• Channels must be compatible with 2-wire and 4-wire resistance measurements.

• Desired specifications include a max voltage of +/- 300V, minimum scan rate of 100 channels/second, max current of 1A, resistance range of 100 Ohms to 1 GOhm, target basic resistance accuracy of 0.004%, and basic DC voltage accuracy of 0.003%.

• The system must accommodate screw connections for input wires and include data logging, analysis, and export software compatible with Windows 10/11.

• The DAQ system will be used in conjunction with an environmental chamber for variable temperature and humidity testing.

• Delivery is due no later than 20 weeks after receipt of order.

• Place of Delivery: NIST (Gaithersburg), 100 Bureau Drive, Building 301, Gaithersburg, MD 20899.

• All equipment must be new; used, remanufactured, experimental, prototype, or custom items are not acceptable.

• "Gray market" components are not acceptable.

• All items must be shipped in original manufacturer packaging with all original documentation and software.

• The system must be warranted for a minimum of 12 months after receipt.

• Cybersecurity and privacy requirements consistent with federal laws and NIST standards (e.g., FISMA, OMB A-130, SP 800-171) must be met, including specific controls for system security, access, vulnerability scanning, auditing, incident response, and encryption.

• Delivery shall be F.O.B Destination.

• Payment will be 100% after installation and acceptance by the NIST Point of Contact (POC) of the fully installed system, upon receipt of a proper invoice.

• Partial shipments and invoices will not be accepted unless approved by the Contracting Officer prior to award.

• NIST reserves the right to perform performance tests and evaluations.

• A visual inspection for surface defects or transport damage will be conducted.

• NIST will test, inspect, and accept or reject equipment within 14 days of receipt.

• The Government may conduct quality assurance testing to confirm performance specifications.

Solicitation / RFP / RFQ

This is a solicitation for commercial products or services, issued as a Request for Quotation (RFQ) under Revolutionary FAR Overhaul (RFO) Part 12. The government is procuring a Data Acquisition System, including shipping, installation, and training. This is an unrestricted competition.

• CLIN 0002: Shipping, Installation, and Training

• CLIN 0003: Other transportation related charges (Not-to-Exceed amount)

• Detailed requirements are specified in Attachment #1: STATEMENT OF WORK/REQUIREMENTS DOCUMENT AND DRAWINGS.

• Contract Type: Firm-fixed-price purchase order (PO).

• Delivery and acceptance dates, and FOB point are detailed in the Statement of Work.

• Submission Deadline: March 9, 2026, by 11:00 am Eastern Time.

• Submission Method: Electronic quotations via email to tracy.retterer@nist.gov and Donald.collie@nist.gov. Reference the RFQ number in the subject line.

• Inquiries: Submit written questions to the Contract Specialist and Contracting Officer no later than 5 calendar days after solicitation issuance.

• Quotation Structure: Must be divided into three volumes:

  • Volume I: Technical Quotation (demonstrate capability, cite SOW paragraphs, provide evidence of meeting requirements, include manufacturer authorization if applicable).
  • Volume II: Price Quotation (firm-fixed-price for each CLIN, include shipping, identify foreign product charges/tariffs separately).
  • Volume III: Terms and Conditions (complete required information, state any exceptions).

• Evaluation Criteria: Award will be made to the responsible offeror proposing the lowest price that is technically acceptable. Award will be based on meeting all required technical specifications and the lowest price.

• NAICS Code: 334516 with a small business size standard of 1,000 employees.

• Registration: Offerors must have an ACTIVE registration in SAM.gov at the time of quotation submission, award, performance, and through final payment.

• Incorporated provisions and clauses are those in effect through the RFO.

• Quotation prices must remain valid for 90 days.

• The government may award without discussions based on initial quotes.
