Justification & Eligibility
This acquisition was justified as a sole-source procurement under 41 U.S.C. 1901, as implemented in FAR 13.106-1(b)(1), due to the proprietary nature of M.I.C. Industries' UBM and building system, for which the government has previously invested. The acquisition was set aside for 100% small businesses, enabled by an SBA Non-Manufacturer Rule (NMR) class waiver for NAICS 332312, allowing small businesses to act as prime contractors by reselling the brand-name product.
