Amendment / Modification

This document is an addendum to FAR 52.212-1, "Instructions to Offerors - Commercial Products and Commercial Services." It modifies and adds to existing FAR 52.212-1 instructions for the solicitation of Reference Laboratory Services.

Key changes and additions include:

• Period for Acceptance of Offers: Offerors must hold prices firm for 180 calendar days from the proposal receipt date.
• Debriefings: Unsuccessful offerors requesting information will receive a debriefing.
• Proposal Submission Instructions:
  • Proposals must consist of five separate volumes: Business, Technical, Performance Risk, Small Business Subcontracting, and Price.
  • Each volume must be clearly labeled with offeror information, CAGE code, UEI, volume number, and title.
  • Proposals must be submitted via email, with a maximum email size of 20MB. USB drives, CDs, DVDs, and floppy/zip discs are not acceptable.
  • Offerors must request delivery and read receipts, and the Government will provide confirmation of receipt within four business hours.
  • Only the last complete proposal submitted by the due date will be evaluated if multiple proposals are submitted.
  • General formatting requires 11-point font, 8.5x11 inch pages with 1-inch margins. Tables and illustrations may use a reduced font size (not less than 8-point) and may be landscape.
  • Page limitations for the Technical Proposal (45 pages) and other volumes are specified.
  • Information must be confined to the appropriate volume/section for evaluation.
  • Cross-referencing between volumes is not permitted for evaluation purposes.
• Questions and Answers: Offerors may submit questions via Exhibit B to the Contracting Officer and Contract Specialists.
• Basis for Award: A best-value tradeoff process will be used. Proposals must meet minimum requirements, including an "Acceptable" rating for Technical and Small Business Subcontracting, and "Satisfactory Confidence" or higher for Performance Risk. Prices must be fair, reasonable, and balanced.
• Evaluation Factors: Proposals will be evaluated on four factors in descending order of importance: Technical, Performance Risk, Small Business Subcontracting Participation, and Price. Non-price factors combined are significantly more important than Price.
• Volume I - Business Proposal: Includes requirements for a cover letter, table of contents, administrative contact data, SF 1449, SF 30 (for amendments), and representations and certifications (active SAM.gov registration required).
• Volume II - Technical Proposal: Must demonstrate capability to meet PWS requirements, be self-contained, and avoid restating the PWS. It includes sub-factors for Cybersecurity, Transition and LIS Deployment; Technical Requirements; Quality Control/Assurance; and Supply Chain Management.
  • Cybersecurity Compliance: Offerors must provide evidence of current CMMC Final Level 2 (Self) assessment in SPRS or a narrative plan for future compliance. Active CMMC Level 2 (Self) in SPRS is a mandatory condition for award.
• Volume III - Performance Risk: Requires a minimum of three and a maximum of five contract references, including Past Performance Summary Sheets and Past Performance Questionnaires (PPQs).
• Volume IV - Small Business Subcontracting: Includes a Subcontracting Plan (for other-than-small businesses) and a Small Business Participation Commitment Document (for all offerors), detailing minimum percentage goals for various small business categories.
• Volume V - Price Proposal: Requires firm-fixed prices for all CLINs, including transition activities and testing services, for the entire ten-year period of performance. Offerors must not add separate escalation factors. The Government will calculate a Total Evaluated Price (TEP) including a 5% escalation ceiling.

This addendum modifies FAR 52.212-1, impacting proposal preparation, submission, evaluation, and basis for award.

Proposal deadlines remain as stated in SF-1449, block 8. Offerors must strictly adhere to the detailed instructions for proposal structure, content, formatting, and submission methods outlined in this addendum. Failure to comply may result in a proposal being deemed non-compliant or unacceptable.

Questions & Answers / Clarifications

This document contains questions submitted by potential offerors and the Government's responses regarding the solicitation for Clinical Reference Laboratory Testing Services (RFP HT001526RE001).

• Small Business Participation: The Government will retain the Small Business Subcontracting Participation evaluation factor, citing DFARS 215.304(c)(i). However, the criteria have been tailored to allow offerors to demonstrate a 'Good Faith Effort' if quantitative goals cannot be met, supported by detailed explanations and verifiable documentation of barriers. Relying solely on a Commercial Subcontracting Plan with lower goals will result in an 'Unacceptable' rating for Factor 3.
• Small Business Participation Documentation: Verifiable documentation for 'Good Faith Effort' may include market research records, records of direct outreach, written declinations from potential subcontractors, capability crosswalks, and documentation of event participation.
• Turnaround Time (TAT): TAT measurement is an all-inclusive, end-to-end metric, starting from specimen pickup at the Government facility and ending when the final result is available in MHS GENESIS. Offerors must define their TAT metrics, which will establish the contract baseline for post-award monitoring, not for source selection evaluation.
• Onsite Personnel Trigger: The requirement for onsite personnel is triggered only if both thresholds (2,000 specimens per month AND $30,000 in monthly expenditure) are met simultaneously. The Government will use a rolling quarterly average to evaluate this requirement.
• Economic Price Adjustment (EPA): An EPA is included, tied to the Producer Price Index (PPI) for NAICS 621511. A combined 5% ceiling for Technology and Pricing Refresh (TPR) and EPA applies cumulatively across the ten-year contract period.
• Volume Estimates: Volume estimates provided are for informational purposes only and do not constitute a guarantee of future order volume. Only the stated minimum order quantity for the base period is guaranteed.
• MHS GENESIS Interface: The Government will provide necessary technical specifications, points of contact, and access to test environments for interface development during the transition period. However, the contractor is solely responsible for successful development, testing, and implementation.

These clarifications provide detailed guidance on evaluation criteria, performance metrics, and contractual mechanisms, impacting how offerors should prepare their proposals, particularly concerning small business participation, TAT definitions, and pricing strategies. The Government does not anticipate extending the proposal due date.
