Amendment / Modification

This document is a revision (Revision 1) to Federal Acquisition Regulation (FAR) Class Deviation 20-05, concerning the prohibition on contracting for certain telecommunications and video surveillance services or equipment. This revision incorporates additional text from the FAR interim rule (Federal Acquisition Circular 2020-08), effective August 13, 2020, into the existing deviation. The interim rule adds definitions and prohibitions related to Section 889(a)(1)(B) of the NDAA for Fiscal Year 2019. The revision does not alter the reporting requirements previously established in FAR Class Deviation 20-05, which mandate concurrent reporting of incidents to the contracting officer, COR, and Enterprise Security Operations Center (SOC).

• The clause 52.204-25, "Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment," has been updated with text from the interim rule.

• Subparagraph (d) reporting requirements remain unchanged from the previous deviation.

• Contracting officers are required to include this deviated clause in solicitations issued on or after August 13, 2020, and in resultant contracts.

• Existing indefinite delivery contracts, blanket purchase agreements, and basic ordering agreements must be modified to include this deviation for orders placed on or after August 13, 2020.

• Options or modifications extending contract performance periods must also incorporate this deviated clause.

• For efficiency, this deviation does not include FAR clauses 52.212-5, 52.213-4, and 52.244-6. When these clauses are used, the full text of the 52.204-25 deviated clause must be included.

• The deviation is applicable to all solicitations and contracts awarded on or after August 13, 2020.

• The deviation remains in effect until incorporated into the Homeland Security Acquisition Regulation or rescinded.
