Terms and Conditions

This document outlines the terms and conditions applicable to orders resulting from solicitation 70Z03826QB0000078. It supersedes all other terms and conditions.

• Offer Acceptance Period: Offerors must hold prices firm for 60 calendar days from the offer receipt date.

• Quotation Submission: Offerors must submit the "Requirement, 70Z03826QB0000078" document with the unit price column completed.

• Evaluation Method: The solicitation is anticipated to be a Total Small Business Set-aside. Award will be made to the lowest priced offeror rated technically acceptable. Technical acceptability will be evaluated based on the ability to provide new manufactured commercial items from the Original Equipment Manufacturer (OEM) or an OEM-approved source. Exact part numbers must be listed on the requirements schedule.

• Pricing Evaluation: Prices will be evaluated for fairness and reasonableness. Quantity price discounts and prompt payment discounts should be included.

• Responsibility Certifications: Offerors must certify regarding debarment, suspension, proposed debarment, criminal offenses, civil judgments, and delinquent Federal taxes. Specific provisions (52.209-5 and 52.209-11) detail these requirements.

• Security Prohibitions and Exclusions: The document includes provisions related to covered telecommunications equipment and services, FASCSA orders, and restricted business operations in Sudan and Iran. Offerors must review and certify compliance.

• Quality Assurance: Applicable to orders for products that will ultimately touch USCG aircraft. Requires immediate notification of any event, supply change, malfunction, or non-airworthy condition that could cause non-conformity. A quality control manual addressing risk management, testing, and counterfeit/suspect parts is required.

• Packaging, Marking, and Shipping Instructions: Detailed instructions are provided for packaging (prohibiting popcorn, shredded paper, Styrofoam, or peanut packaging), marking, and shipping to the USCG Aviation Logistics Center in Elizabeth City, NC.

• Inspection and Acceptance: Performed at destination by local USCG personnel, focusing on count and condition. Certificates of Conformance and Airworthiness may be required.

• Deliveries: F.O.B. Destination is the requested delivery term.

• Invoicing: Invoices are to be submitted IAW FAR 52.212-4 to the designated billing office, preferably electronically.

• Option for Increased Quantity: For Line Item 1, the Government may increase the quantity by up to 15 units, with a maximum increase of 30 units, at the specified unit price, exercisable within one year of award.

• Sustainable Products and Services: Requirements for biobased products, recovered materials, ENERGY STAR® certified products, and other EPA-designated items are outlined.

• Several FAR and HSAR provisions are incorporated by reference and may include deviations.
