• Language: All offers must be submitted in English.

• Submission Method: Offers/proposals must be emailed to the specified contracting officers.

• Submission of Offers (Section 5): Details on pricing, separate technical proposals, language, and submission method are clarified.

• Technical Proposal (Section 6): Outlines the required content and format for the technical proposal, including:

  • Company Name restrictions
  • Title Page requirements
  • Table of Contents
  • Content: Equipment List, Delivery Plan, and Management Plan.

• Evaluation (Addendum to 52.212-2): Clarifies that award will be made to the lowest priced, responsive, and responsible firm with an acceptable Technical Proposal. Technical proposals will be evaluated as Acceptable or Unacceptable. Price will be evaluated by calculating the Total Evaluated Price, including any offeror-added CLINs.

This addendum provides specific instructions on how to format and submit proposals, including the technical proposal and pricing. It also clarifies the evaluation criteria, emphasizing a Lowest Price, Technically Acceptable (LPTA) approach.

• Evaluation will be based on Technical and Price factors.

• This acquisition is UNRESTRICTED.

• The solicitation incorporates FAR clauses by reference, including FAR 52.212-1, 52.212-3, 52.212-4, and 52.212-5.

• Specific delivery and inspection/acceptance locations are detailed, with delivery to Cristobal, Colon being a common instruction.

Statement of Work (SOW) / Performance Work Statement (PWS)

To provide leased construction equipment, refueling services, and non-potable water replenishment for water trucks to support U.S. Army engineer operations at Cristóbal Colón.

• Provide leased construction equipment, including water trucks, bull dozers, rollers, motor graders, front-end loaders, hydraulic excavators, dump trucks, backhoes, skid steers, and telescoping forklifts.

• Deliver and refill non-potable water for soil compaction and water trucks.

• Provide daily refueling for all leased equipment.

• Perform maintenance on engineer equipment.

• Drivers will operate water trucks for replenishment and delivery; U.S. forces will operate water trucks during construction tasks.

• Equipment must be fully operational and topped off with fuel upon delivery.

• Maintenance support response within 3 hours of COR notice.

• Vehicle recovery operations within 3 hours of COR notification.

• Notification of government-caused damage within 24 hours.

• Compliance with Panamanian safety regulations and use of required PPE.

• Immediate reporting of accidents, injuries, or equipment incidents.

• Period of Performance: May 14, 2026, to July 12, 2026.

• Place of Performance: Cristóbal Colón, formerly known as Fuerte Sherman/Fort Sherman.

• Contractor must comply with all applicable Panamanian safety laws and regulations.

• Personnel must wear appropriate safety gear, including short sleeve shirts, long trousers, steel-toed boots, and hard hats in designated areas.

• Contractor must provide a list of all vehicles used in performance of the contract.

• Contractor must provide background checks for employees and notify KO/COR of any criminal activity or suspicious activity.

• Contractor must comply with information assurance and security requirements.

• Contractor must provide a contract manager and alternate, available during specified hours.

• Data rights for all documents/material produced under this contract belong to the Government.

Solicitation / RFP / RFQ

This document provides "Instructions to Offerors—Commercial Products and Commercial Services" (FAR 52.212-1) for the solicitation. It outlines the requirements for submitting offers for commercial products and services.

• Offers must include:

• The Government may make an award on any item for a quantity less than the quantity offered.
