Statement of Work (SOW)

To provide Magnesium Chloride application for dust abatement on gravel roads within Black Canyon National Park and Curecanti National Recreation Area in Gunnison, Colorado.

• Application of Magnesium Chloride solution to specific roadways.

• Black Canyon National Park (North Rim Road): 9 miles of roadway, 18' wide, at a rate of 0.50 gallons per square yard. Total allowable gallons: 39,000 per year.

• Curecanti National Recreation Area: 8.7 miles of roadway, 18' wide, at a rate of 0.25 gallons per square yard. Includes application on multiple short roadways and Ponderosa Campground. Total allowable gallons: 22,400 per year.

• Application spray pattern must cover the entire 18' roadway in one pass.

• Contract Line Item 00030 includes hauling and application of water (estimated 6,000 gallons) for the North Rim Road.

• Magnesium Chloride Solution Specifications:

  • Chemical Properties: 30-33% Magnesium Chloride; Sulfates 0-3.5%; Potassium 0-0.5%; Sodium 0-0.7%
  • Physical Properties: Clear to yellow; 10.85-11lbs per gallon; 6-7.5 pH of a 5% solution.
  • Constituents: Specific limits for Total Phosphorous, Barium, Zinc, Molybdenum, Cyanide, Mercury, Arsenic, Copper, Lead, Chromium, Cadmium, Selenium, Ammonia or Nitrogen.

• Payment based on actual material applied, not to exceed award amount.

• Period of Performance: 14 calendar days after Notice to Proceed (NTP).

• Work Dates: Estimated April 13, 2026 – May 1, 2026. Exact date to be coordinated based on road conditions (moisture and freezing conditions).

• Location: Black Canyon of the Gunnison National Park (North Rim Road) and Curecanti National Recreation Area.

• Contractor must adhere to all roadway use regulations, park requirements, rules, regulations, and posted speed limits.

• Submittals required prior to work commencement include: all products/chemicals, Material Safety Data Sheets (MSDS), and an Insurance Certificate.

• Payment requests submitted electronically via the U.S. Department of the Treasury's Invoice Processing Platform System (IPP).

• Contractor shall ensure dust suppressant meets specifications upon delivery.

Wage Determination

This document, "REGISTER OF WAGE DETERMINATIONS UNDER THE SERVICE CONTRACT ACT," issued by the U.S. Department of Labor, Wage and Hour Division, provides the minimum wage rates and fringe benefits required for various occupations performing contract work in Colorado. This specific determination is Revision No. 29, dated 12/03/2025, for the area covering Colorado Counties of Archuleta, Chaffee, Delta, Dolores, Fremont, Gunnison, Hinsdale, La Plata, Montezuma, Montrose, Ouray, San Juan, and San Miguel.

• Minimum Wage Rates: A comprehensive list of occupation codes, titles, and their corresponding minimum hourly wage rates is provided. This includes a wide range of occupations from administrative support and clerical to technical, transportation, and protective services.

• Fringe Benefits: Specific fringe benefits are required and follow the occupational listing. These include Health & Welfare benefits at $5.55 per hour (or $222.00 per week/$962.00 per month) and a Health & Welfare EO 13706 rate of $5.09 per hour (or $203.60 per week/$882.27 per month).

• Executive Order (EO) 13706 (Paid Sick Leave): For contracts awarded on or after January 1, 2017, contractors must provide employees with 1 hour of paid sick leave for every 30 hours worked, up to 56 hours annually. This leave can be used for personal illness, injury, or health-related needs, or to assist family members.

• Executive Order 13658 (Minimum Wage): For contracts awarded between January 1, 2015, and January 29, 2022 (and not renewed/extended after January 30, 2022), the contractor must pay covered workers at least $13.30 per hour (or the applicable wage determination rate, if higher) for work performed in 2025. This rate is adjusted annually.

• Vacation: Paid vacation is mandated based on years of service: 2 weeks after 1 year, 3 weeks after 5 years, and 4 weeks after 15 years.

• Holidays: A minimum of eleven paid holidays are required annually.

• Hazardous Pay Differential: An 8% differential applies to positions with a high degree of hazard (ordnance, explosives), and a 4% differential applies to positions with a low degree of hazard.

• Uniform Allowance: Contractors must furnish uniforms or reimburse employees for their cost, including maintenance, at a rate of $3.35 per week (or $.67 per day), unless specific conditions apply.

• Conformance Process: If a required classification is not listed, contractors must initiate a conformance process to establish a wage rate and fringe benefits, which requires submission of an SF-1444 form.

• This document does not specify set-asides but outlines wage and benefit requirements applicable to contractors performing work under the Service Contract Act.

• The wage determination does not apply to bona fide executive, administrative, or professional employees as defined by 29 C.F.R. Part 541, particularly exempt computer professionals.

• The duties described in the "Service Contract Act Directory of Occupations" are the basis for classification.

• This requirement is a 100% total small business set-aside.

• Offerors must be registered in the System for Award Management (SAM) and be considered a small business for the specified NAICS code.

• This solicitation is issued under FAR Part 13 Simplified Acquisition Procedures.
