Justification for Other Than Full and Open Competition
The statutory authority cited for this action is 10 U.S.C. 3204(a)(2) and FAR 6.302-2 (Unusual and compelling urgency). The original NTE capacity was deemed insufficient due to critical projects identified for FY26 that, if delayed, would result in serious injury to mission-critical operations at various Navy and Marine Corps installations. Utilizing the existing MACC for Design-Build projects is estimated to be 60% faster than standalone contracts, offering a more cost-effective and timely solution. Other NAVFAC SE MACCs are also nearing capacity exhaustion, and a new MACC is not anticipated to be awarded in time to meet these immediate needs.
