Statement of Work (SOW) / Performance Work Statement (PWS)

This Statement of Work (SOW) outlines the requirements for CERCLA Enforcement Support Services (CESS) to assist EPA Regions 7, 8, 9, and 10. The primary goal is to identify and involve Potentially Responsible Parties (PRPs) in cleanup processes for hazardous substance releases, ultimately reducing threats to human health and the environment.

The scope includes PRP search activities at various types of sites, ranging from simple to complex, and from removal to remedial sites. Task areas may overlap and include:

• Potentially Responsible Party (PRP) Searches (including name/address verification, waste-in lists, volumetric ranking, financial assessments, and investigations).
• Document/Record Collection, Gathering, and Compilation.
• Expedited General Enforcement Support (service of process, liens, deed restrictions, FOIA).
• Negotiation, Litigation, Expert, and Referral Support.
• Quarterly Cost Recovery and Statute of Limitations Status Report Preparation.
• Cost Recovery Support.
• Community Involvement Support (public meetings, fact sheets, public notices).
• Project Management, Planning, and Support.

Contractor performance will be evaluated based on an Acceptable Quality Level (AQL) of "Good" as a minimum. Performance categories include Quality of Services Delivered, Initiative in Meeting Contract Requirements, Timeliness of Performance, Cost Control, Business Practices, and Customer Satisfaction. Performance is rated on a scale from Unsatisfactory to Exceptional.

Services will be provided to EPA Regions 7, 8, 9, and 10. The period of performance is not specified in this document but will be defined by Task Orders.

• Contractor must comply with all applicable federal, state, and local laws, regulations, and policies.
• Contractor must develop a Quality Management Plan (QMP) and Quality Assurance Project Plan (QAPP).
• Contractor must have Microsoft Teams video/visual conferencing capabilities.
• All deliverables must be submitted electronically unless otherwise directed.
• Contractor and subcontractors must adhere to federal government security regulations, policies, and guidance, including those related to Controlled Unclassified Information (CUI) and EPA privileged information.
• Handling of PII, SPII, CBI, and attorney work product requires specific encryption and transmission protocols.
