Purpose & Scope

The BOP seeks to identify vendors who can provide nicotine pouch products with current FDA-issued Marketing Granted Orders (MGOs) for resale to the inmate population across approximately 122 institutions. The objective is to assess vendor capabilities, product availability, regulatory compliance, nationwide distribution capacity, pricing structure, and operational support.
Information Requested
Vendors are requested to provide detailed information covering:
- Company Information: Name, corporate structure, UEI/CAGE, NAICS/PSC, years in business, relevant experience (correctional facilities, government agencies), financial/operational capacity, and distribution/warehousing capabilities.
- Product Information: Brand, description, nicotine strengths, flavors, packaging, shelf life, country of manufacture, FDA authorization status (MGOs), dimensions, safety data sheets, and packaging features for institutional security. Vendors must specify if products contain tobacco-derived, synthetic, or other nicotine formulations.
- FDA Compliance: Current FDA MGOs, ongoing regulatory compliance documentation, and disclosure of any enforcement actions or recalls.
- Operational & Distribution: National distribution capabilities, warehousing, ability to fulfill large-volume orders, lead times, backorder mitigation, inventory management, product tracking, expiration-date management, and direct shipping to federal correctional institutions. Experience with secure facilities and compliance with state/local regulations are also requested.
- Security & Institutional Considerations: Product/packaging characteristics for correctional environments (tamper-evident, limited metal, clear visibility), and awareness of institutional policies.
- Pricing Information: Estimated wholesale pricing, volume discounts, MOQs, freight, price stability, and return/exchange/credit policies for various scenarios.
