This solicitation is a combined synopsis/solicitation for Commercial Services, prepared in accordance with FAR Subpart 12.6. It constitutes the only solicitation, and proposals are being requested. • Quotation Due Date & Time: Must be received on or before the date and time specified on the SF-1449. The specific date is December 31, 2025, by 5:00 PM CST.

• Submission Method: Quotes must be submitted via email to Teihahnietuh.McCargo@bia.gov with the subject line: “Company Name Quote in Response to 140A0126Q0013”.

• Evaluation Factors: Offers will be evaluated based on Lowest Price - Technically Acceptable. Technically unacceptable quotes will NOT be considered. Evaluation will consider:

  • Factor 1: Past Performance (evaluated as Pass/Neutral or Fail). Offerors must provide a minimum of two references from the last three years.
  • Factor 2: Ability to meet SOW requirements with qualified personnel and products.

• Options: Offers will be evaluated by adding the total price for all options to the total price for the basic requirement.

• This requirement is 100% set-aside for Indian Small Business Economic Enterprise (ISBEE).

• NAICS Code: 722310 Food Service Contractors, with a Small Business Size Standard of $47.0M.

• The solicitation incorporates numerous FAR and DIAR clauses by reference. Offerors are cautioned to review these carefully.

Statement of Work (SOW) / Performance Work Statement (PWS)

To procure food services, including preparation and delivery, for the Bureau of Indian Affairs (BIA), Office of Justice Services (OJS), Fort Totten Agency Correctional Facility.

• Provide three nutritious meals per day (breakfast, lunch, dinner) for adult inmates.

• Accommodate special dietary requirements, including diabetic, vegetarian, kosher, halal, and lactose intolerance.

• Deliver meals in accordance with industry standards, including the U.S. Food & Drug Administration Food Code.

• Provide all necessary personnel, equipment, supplies, and facilities for food services.

• Prepare and deliver two hot meals and one cold meal daily, seven days a week.

• Hot meals must be at least 135°F, and cold meals no more than 70°F, maintained for no more than two hours from preparation to delivery.

• Facility is not equipped to store or reheat meals; meals must be ready to serve.

• Ensure meals meet a minimum daily caloric intake of 2,000-2,500 calories, with each meal between 667-833 calories, including protein, vegetable, fruit, carb, and drink.

• Period of Performance includes a Base Period (Date to be Awarded) and four Option Periods, each one year in duration, from February 1, 2027, through January 31, 2031.

• Place of Performance: Bureau of Indian Affairs, Office of Justice Services, Fort Totten Correctional Facility, 105 2nd Avenue North, Fort Totten, North Dakota 58370.

• Meals must be prepared and packaged to avoid foodborne pathogens.

• Kitchen facilities, equipment, and operations must meet recognized food service industry standards.

• Meal presentations must be acceptable by normal industry standards.

• Contractor shall maintain a meal tracking log including meal quantities, temperatures, descriptions, and special dietary accommodations.

• Contractor shall provide monthly menus to the facility, subject to review by a registered dietitian.

• Contractor is responsible for all food products and supplies; facility provides utensils.

• Deliveries must be accompanied by an itemized delivery ticket.

• Containers for transportation must be agreed upon by BIA OJS and the Contractor.

• Facility is responsible for returning contractor containers and supplies upon contract termination.

• Invoices must include the number of deliveries and quantity of each meal type.
