Quick Summary
The U.S. Patent and Trademark Office (USPTO), under the Department of Commerce, is conducting market research through a Request for Information (RFI) for "Fraud Identification, Unsupervised AI, and Preventing Impersonations." This effort seeks advanced AI/ML solutions to enhance trademark operations by combating fraud, identifying "bad law," and preventing impersonations. Responses for Stage One are due May 6, 2026.
Scope of Work
The RFI focuses on three key areas:
- Fraud Identification, Suppression, and Defeat: Automating monitoring for anomalous filing behavior, identifying high-risk applications, validating attorney credentials, and detecting fraudulent credit card transactions.
- Unsupervised AI: Uncovering "Bad Law": Verifying the accuracy of case law citations and facts in trademark submissions, and detecting AI-generated specimens of use that do not reflect actual use in commerce.
- Discovering Impersonations: Developing tools for customers to auto-validate communications purportedly from the USPTO to combat scams and impersonations.
Contract Details
- Type: Sources Sought / Request for Information (RFI) for market research purposes only. This is not a solicitation for a contract.
- Set-Aside: None specified.
- Eligibility: Vendors must be FedRAMP certified or actively pursuing certification. FedRAMP SaaS is preferred, and "FedRAMP-ready" status will be considered, but full authorization is preferred.
- Approach: USPTO prefers a "buy-vs.-build" acquisition strategy but is open to bespoke or platform-based solutions. Solutions must be legally sustainable, and explainability is important. Vendors can propose separate solutions for each area or a single integrated solution.
- Data: USPTO will provide sample data for training and demonstration, with integration into existing systems being desirable.
Submission & Evaluation
This is a multi-staged market research approach. Stage One requires vendors to submit a questionnaire response. Based on these responses, selected vendors may be invited to subsequent stages, including concept papers and prototype demonstrations. The research will inform potential future solicitations.
