Justification for Other Than Full and Open Competition

This document justifies the procurement of a High Temperature Calibrator (Part Number: 3604A-1-101) from King Nutronics on a brand name/sole source basis. The justification is based on the item being peculiar to one manufacturer and the need to ensure compatibility with existing systems.

The justification cites FAR 8.405-6(b) - Items peculiar to one manufacturer (brand-name item) and FAR 16.505(b)(2)(i)(C) - logical follow-on to an order already issued under the contract, in the interest of economy and efficiency.

• The items must be compatible in all aspects (form, fit, and function) with existing systems.

• King Nutronics is the Original Equipment Manufacturer (OEM) and does not have authorized distributors or resellers.

• Procuring other brands would lead to failure of repair due to the proprietary nature of King Nutronics' systems.

• Potential for unacceptable delays in fulfilling agency requirements.

• Substantial duplication of cost to the Government.

• Failure of repair due to proprietary system workings.

• A BPA N6426725A4016 was awarded as a result of this justification.

• The Corona Division has no plans at this time to compete future contracts for these supplies/services.

• Future competition will be assessed if another potential source emerges.

Solicitation / RFP / RFQ

This document is a Request for Quote (RFQ) for the acquisition of 15 units of High Temperature Calibrators. The procurement is being conducted under FAR Part 12 and is a Firm Fixed Price (FFP) contract.

• Item: High Temperature Calibrator, Part Number: 3604A-1-101, Brand: King Nutronics.

• Quantity: 15 Each.

• TAA Compliance: Supplies must be Trade Agreements Act (TAA) compliant. No alternatives will be accepted.

• Item Identification: Requirements in DFARS 252.211-7003, Item Identification and Valuation, are applicable. Contractors must provide DoD unique identification or a DoD recognized unique identification equivalent.

• Packaging: Supplies must be packaged in accordance with ASTM-D-3951-18, Standard Practice for Commercial Packing. Specific marking and packing list requirements are detailed.

• Prohibited Packing Materials: Asbestos, excelsior, newspaper, shredded paper, yellow wrapping/packaging material (except for radioactive material containment), and loose fill polystyrene for shipboard use are prohibited.

• Contract Type: Firm Fixed Price (FFP).

• Period of Performance: Delivery is from the date of lead time event to delivery, within 120 Calendar Years from the Date of Award.

• Maximum per Order: $250,000.00.

• Government Minimum/Maximum to Order: $250,000.00.

• Quote Submission: Offerors must provide complete information as requested, including CAGE Code, Delivery Date/Lead Time, Pricing for all CLINs, and information on quoted items (Part Numbers, SKUs, etc.). Quotes must be valid for a minimum of 30 days.

• Acceptance of Terms: Submitting a quote signifies acceptance of all terms and conditions. Alternative terms will not be considered.

• Evaluation: Award will be made to the responsible Offeror whose quote fully complies with the solicitation and is most advantageous to the Government based on price analysis. Offers must be for all units of all items.

• F.O.B. Basis: Offers submitted on an F.O.B. basis other than specified in Section F will be rejected.

• The "Offeror Submission Cover Page" includes checkboxes for various business sizes (Small Business, Emerging Small Business, Small Disadvantaged Business, Certified under Section 8(a), HubZone, Woman Owned, Certified Service-Disabled Veteran Owned Small Business, Certified Veteran Owned Small Business, Large Business, Other). Bidders should select all that apply.

• OEM Authorization: Offerors must be an OEM, authorized dealer, authorized distributor, or authorized reseller and provide proof of authorization.

• Gray Market Items: Gray market items are not acceptable. Equipment must be new from the OEM.

• Payment: Payment requests and receiving reports must be submitted electronically via Wide Area WorkFlow (WAWF).

• Unique Item Identification (IUID): Required for items with a unit cost of $5,000 or more, in accordance with DFARS 252.211-7003. IUID costs should be inclusive in the total price if not separately identified.
