• Eligibility Requirements: Offerors must meet the definition of an "Indian Economic Enterprise" at the time of offer, contract award, and throughout the contract performance period. Failure to meet these requirements necessitates immediate written notification to the Contracting Officer.
• Representation: Offerors must indicate whether they do or do not meet the definition of an "Indian Economic Enterprise" with "Indian Ownership."
• Required Information: The form requires the Offeror to provide:
  • Name of Federally Recognized Tribal Entity
  • Name of the 51% owner of the IEE Firm
  • Business Name
  • Unique Entity ID (UEI) Number
  • Certifying Signature
  • Print Name
• Legal Consequences: Submission of false or misleading information is a violation of law, punishable under 18 U.S.C. 1001, and false claims are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287.
• Additional Requirements: Offerors must also be registered with the System of Award Management (SAM).

This form is critical for any bidder seeking to participate in opportunities designated for or requiring self-certification as an "Indian Economic Enterprise" under the Buy Indian Act. Bidders must accurately complete and submit this form to affirm their eligibility. Failure to meet the criteria or provide accurate information can lead to disqualification or penalties. Contracting Officers may request further documentation to verify eligibility.

Statement of Work (SOW) / Performance Work Statement (PWS)

This Performance Work Statement (PWS) outlines the requirements for providing non-personal service nursing services, specifically for the Emergency Department (ED), to support the Indian Health Service (IHS) at the Standing Rock Service Unit (SRSU) in Fort Yates, North Dakota.

• The contractor will provide nursing services, primarily focusing on emergency department services, but potentially encompassing inpatient nursing services.

• Services include providing a full range of emergency nursing care, applying the nursing process for individualized care, and addressing the physical, spiritual, and socio-cultural needs of patients.

• Duties involve administering medications, analyzing medical procedures, working harmoniously within the healthcare team, and documenting care using the SRSU Electronic Health Record (EHR) system.

• The contractor must adhere to facility policies, TJC, OSHA, IHS, and other federal licensing standards.

• Performance will be evaluated based on a Quality Assurance Surveillance Plan (QASP) matrix.

• Key performance indicators include competency, compliance with policies, patient outcomes (no breaches in safety or infection control), professionalism, credentialing, documentation standards, and service quality as evidenced by customer input.

• Substantiated reports of patient safety, infection control, or other adverse patient outcomes constitute a breach of contract.

• Place of Performance: 10 Standing Rock Ave, Fort Yates, ND 58538.

• Period of Performance: A 14-month base period (April 1, 2026 - May 31, 2027), followed by four 1-year option periods.

• A transition period (April 1, 2026 - May 31, 2026) is included for onboarding and credentialing.

• The ED operates 24 hours a day, 7 days a week, 365 days a year.

• Contractor must provide a point of contact for contract administration, including credentialing, timecard verification, invoicing, and ED nurse management.

• A contract kick-off meeting is required within 5 business days of award.

• Weekly status update calls and an ongoing Action Item list are mandatory.

• A 24/7 contact number for emergent staffing situations is required.

• Staffing and recruiting: New staff must be available for submission within 1 week of request and onsite within 1 month.

• Nurses must possess a current, valid, unrestricted nursing license and specific certifications (BLS, PALS, ACLS, PNCC).

• Background checks (Level I and Level II) are required.

• Adherence to HIPAA and other privacy regulations is mandatory.

• Contractor employees must wear government-issued identification badges.

• The contractor is responsible for all applicable Federal, State, and Local Taxes, Meals, Travel/Transportation, and housing.

• A contingency plan for continuity of care is required.
