Justification for Other Than Full and Open Competition

This document justifies the Federal Bureau of Investigation's (FBI) decision to procure External Repairs / Preventative Maintenance services for microscopes used by the Terrorist Explosive Device Analytical Center (TEDAC) through other than full and open competition. The services are required to support forensic research and maintain the FBI Laboratory's ISO 17025 accreditation.

• Annual preventative maintenance and performance checks on Leeds brand LCF microscopes.

• The justification cites 41 U.S.C. 3304(a)(1) and FAR 6.302-1 (Only One Responsible Source) as the statutory authority.

• This procurement is specifically justified for Leeds Precision Instruments, Inc. as the only responsible source.

• Market research identified Leeds Precision Instruments, Inc. as the sole manufacturer and only authorized vendor capable of servicing the microscopes without voiding warranties or causing damage.

• The FBI plans to post a Notice of Intent to Sole Source on SAM.gov.

• The microscopes are located in Huntsville, Alabama.

Statement of Work (SOW) / Performance Work Statement (PWS)

To provide maintenance and calibration services for microscopes supporting forensic laboratory analysis at the FBI's Laboratory Division (LD), Research and Support Unit (RSU) in Huntsville, Alabama.

• Provide all personnel, equipment, supplies, transportation, tools, materials, and supervision for non-personal services.

• Perform quality repair and preventative maintenance (PM) on fifty-four (54) comparison, stereo, and compound microscopes.

• Services include minor repairs, fine focus lubrication, condenser lubrication, stage adjustments, and alignment checks.

• For LCF Firearms and Toolmark Comparison Microscopes, services also include calibration and recertification of magnification match between right and left images, LCD single axis measuring scal, measuring reticule, and imaging software if applicable.

• Services must be performed to the standards defined in this Performance Work Statement (PWS).

• A Quality Control Plan (QCP) must be developed and maintained by the contractor to ensure high-quality service and compliance with contract requirements.

• An inspection program must be included in the QCP covering all general and specific tasks.

• Place of Performance: FBI's Laboratory located on the Redstone Arsenal, Huntsville, AL.

• Hours of Operation: Normal workday 6:00 AM - 6:00 PM, Monday-Friday. Core hours 9:00 AM - 3:00 PM. Flexibility to be coordinated with the COR.

• Non-personal services contract.

• Contractor must adhere to non-disclosure requirements and follow DOJ Regulations (JAR) 2852.203-71 Intelligence Related Non-Disclosure Agreement.

• Contractor must follow FAR Subpart 9.5 and FBI-0030 Organizational Conflict of Interest requirements.

• Contractor is responsible for safeguarding government property.

• Travel requires Government approval/authorization and notification to the COR 14 days prior.

• Monthly status reports to the COR, including Staffing Summary, Hours and Labor performed, current management and administrative problems, and action items.
