Sources Sought Notice

This notice is issued by the Indian Health Service (IHS) to identify potential Indian Small Business Economic Enterprises (ISBEEs) capable of providing Grammarly Business Enterprise software. This is not a solicitation for proposals but an effort to gather information on vendor capabilities to inform the acquisition strategy. The IHS is required to use the Buy Indian Act for preferences to Indian Economic Enterprises when authorized and practicable.

• Vendors must be Grammarly authorized resellers.

• NAICS Code: 541519 – Information Technology Value Added Resellers.

• Size Standard: 150 Employees.

• Interested parties must submit a written response including:

  • Company Name, Address, UEI/CAGE Code
  • Point of Contact (phone and email)
  • Business size and category (IEE, ISBEE, etc.)
  • Business size per NAICS
  • Capability statement
  • Grammarly authorized reseller letter

Statement of Work (SOW) / Performance Work Statement (PWS)

To enhance the professional writing capabilities of approximately 600 Indian Health Service (IHS) employees by procuring an online English writing assistance software tool.

• Provide an online English writing assistance tool with features for paragraph rewriting, comprehensive proofreading, and seamless integration with various desktop and laptop applications (e.g., Microsoft Office Suite, web browsers, email clients).

• Enable users to produce clear, concise, accurate, and high-quality written communications.

• Support enhanced team collaboration and communication through customization of writing styles, consistent organizational language, and knowledge sharing.

• Include advanced functionalities for grammar checking, spelling, punctuation, and stylistic inconsistencies.

• Offer robust data security and privacy protections compliant with federal standards.

• The software must be hosted on-premises or provided as SaaS, complying with FedRAMP at the moderate level if SaaS.

• The solution must comply with federal cybersecurity policies and regulations, including FISMA.

• The contractor must maintain robust security controls, including annual SOC 2 Type II audits and industry-standard practices.

• The contractor must provide a report on September 30 of each year demonstrating monitoring of NIST security controls.

• The contractor must provide quarterly compliance reports.

• Period of Performance: One base year of 12 months and (4) Option Years of 12 months each.

• The solution must include security features designed to protect user data and maintain confidentiality.

• The contractor shall adhere to Privacy and Patient Confidentiality laws, including HIPAA and the Privacy Act.

This document is the "Indian Health Service Buy Indian Act Indian Economic Enterprise Representation Form." It serves as a self-certification for offerors to confirm they meet the definition of an "Indian Economic Enterprise" as required by the Buy Indian Act. This form is to be submitted in response to a Sources Sought Notice, Request for Information (RFI), or Solicitation.

• Self-Certification: Offerors must certify whether they meet the definition of an "Indian Economic Enterprise" with "Indian Ownership."
• Eligibility Period: The enterprise must meet the definition throughout the solicitation response, contract award, and contract performance period. Notification is required if eligibility is lost.
• Documentation: Contracting Officers may request eligibility documentation, and awards may be subject to protest.
• Registration: Successful offerors must be registered with the System of Award Management (SAM).
• Penalties: False or misleading information is subject to legal penalties.
• Required Fields: Offerors must provide the Name of Federally Recognized Tribal Entity (if applicable), Name of the 51% owner of IEE Firm, Business Name, DUNS Number, Certifying Signature, and Print Name.
