Justification and Approval (J&A) for Other Than Full and Open Competition

This document justifies the Department of Veterans Affairs' intent to award a firm-fixed-price (FFP) service contract on a sole-source basis to Liquitech, Inc. for Copper-Silver Ionization System maintenance, monitoring, and compliance testing services at the VA Palo Alto Health Care System (VAPAHCS).

• Maintenance, monitoring, and compliance testing of existing Liquitech, Inc. Copper-Silver Ionization control panels in five buildings.

• Recalibration of equipment.

• Rebuilding of flow cells.

This procurement is being conducted on a sole-source basis to Liquitech, Inc., identified as the Original Equipment Manufacturer (OEM) and the only entity with proprietary access to the specialized equipment. Market research did not identify a reasonable expectation of offers from two or more qualified Service-Disabled Veteran-Owned Small Businesses (SDVOSB) at a fair and reasonable price.

• The government posted a Notice of Intent (NOI) to sole source to LiquiTech, Inc. on SAM.gov on December 30, 2025, and received no responses.
• The government will continue to assess the marketplace for potential alternative solutions or system replacements to increase future competition.

The Department of Veterans Affairs, Network Contracting Office 21, intends to negotiate a sole source contract for on-site CuAg Ionization Services at the VA Palo Alto Healthcare System. This is a Notice of Intent to Sole Source, not a solicitation for competitive proposals.
