Sole Source Justification
The government intends to award this contract to BAE Australia under the authority of 10 U.S.C. 2304(c)(1) and FAR 6.302-1, citing "Only One Responsible Source." BAE Australia's digital receiver technology is proprietary and cannot be repaired by any other company. Furthermore, Memorandums of Understanding (MOUs) between the U.S. DoD and Australian DoD prevent the transfer or disclosure of Australian-origin defense articles to third parties, reinforcing the sole source determination.
