Terms and Conditions

This document outlines the "Terms and Conditions" applicable to the solicitation 70Z03826PF0000149. It incorporates various Federal Acquisition Regulation (FAR) and Homeland Security Acquisition Regulation (HSAR) clauses, many with deviations.

• Instructions to Offerors (52.212-1): Offers must hold prices firm for 60 calendar days. The "Requirement" document (Attachment 1) with completed unit prices is required for quotation submission.
• Evaluation (52.212-2): This solicitation will be awarded on a competitive basis. Quotes will be evaluated based on Federal Acquisition Regulation (FAR) 12. Award will be made to the lowest priced offeror rated technically acceptable. Technical acceptability will be rated as "acceptable" or "unacceptable" based on the ability to provide new manufactured commercial items from the Original Equipment Manufacturer (OEM) or an OEM-approved source, with exact part numbers listed.
• Price Evaluation: Prices will be evaluated for fairness and reasonableness. Quantity price discounts and prompt payment discounts should be included.
• Certifications and Representations: Offerors must certify regarding responsibility matters (e.g., debarment, suspension, convictions, delinquent taxes) and provide representations regarding delinquent tax liability or felony convictions. Specific clauses address prohibitions related to covered telecommunications equipment, services, and entities (e.g., Huawei, ZTE, Hytera, Hikvision, Dahua), as well as restrictions concerning Sudan and Iran.
• Quality Assurance: Applicable to products that will touch USCG aircraft. Requires immediate notification of any event, supply change, material change, malfunction, counterfeit/suspect parts, or defect that could cause non-conformity. A quality control manual addressing risk management, inspection, and counterfeit/suspect parts is required. Changes impacting the product require USCG approval.
• Packaging and Marking: Specific instructions are provided for packaging materials (no popcorn, shredded paper, etc.) and labeling requirements for individual containers and shipping containers, including NSN, Part Number, Nomenclature, S/N, and Purchase Order/Item Number.
• Shipping Instructions: Deliveries are to the USCG Aviation Logistics Center (ALC) at a specified address.
• Inspection and Acceptance: Performed at destination by local USCG personnel. A Certificate of Conformance (COC) is required for all items, signed by an authorized official, specifying nomenclature, part number, and date of manufacture. Full and clear traceability must be provided.
• Delivery Term: F.O.B. Destination is requested.
• Invoicing: Invoices to be submitted IAW FAR 52.212-4 to the designated billing office, with electronic submission encouraged.
• Full Text Clauses: Numerous FAR and HSAR clauses are incorporated by reference, covering areas such as DEI, sustainable products, prohibitions on certain foreign entities and technologies, and various certifications and representations.
