This document provides responses to vendor questions regarding the solicitation for medical supplies, clarifying key aspects of the delivery, scope, and requirements.

• Delivery Destination: The final FOB destination is within Central Ukraine. U.S. and Germany DoDAACs are superseded. The contractor is responsible for all transportation, import, and last-mile delivery. Facility address and POC will be provided post-award. Pricing should be based on the proximity location.
• CLIN Scope: CLINs 0001, 0002, and 0003 must encompass all requirements in Attachment 1, including the laparoscopic system, hysteroscopic complex, energy platform, instruments, consumables, installation, training, and warranty. Pricing must be inclusive of these items and transportation.
• Manufacturer Country Requirement: The end product must be manufactured or substantially transformed in the United States or a Designated Country (as per WTO GPA). A list of acceptable countries is provided. Equipment manufactured in Ukraine or Turkey is evaluated based on this standard.
• Installation and Training: The contractor is responsible for installation, commissioning, and user training at the final site in Ukraine. Standard commercial facility conditions apply; specialized access requirements will be coordinated post-award.
• Warranty and Local Service: A 12-month warranty execution is required. While a Ukraine-based service representative is encouraged, it is not strictly mandated if the vendor can demonstrate timely repair capabilities. A narrative detailing the warranty plan and OEM authorization proof is required.
• DBA / War-Hazard Insurance: Defense Base Act (DBA) and War-Hazard insurance requirements do not apply to this Firm Fixed Price supply purchase. Relevant FAR clauses have been removed, and bidders should not include these premiums in their pricing.
• IUID / SPRS Identifiers: An amendment will clarify IUID requirements. For commercial medical supplies, commercial equivalents like Manufacturer Part Numbers, Serial Numbers, or GS1/UPC codes may be sufficient for tracking and SPRS evaluation if standard DoD IUID marking is deemed unnecessary.

These clarifications refine delivery logistics, scope of work, country of origin requirements, insurance obligations, and item identification. Bidders should ensure their proposals reflect these updated understandings, particularly regarding pricing and logistical responsibilities.

Amendment / Modification

This document consists of two addenda, revising sections of the original solicitation (RFO 12) related to submission instructions and evaluation criteria.

Addendum to 52.212-1 (Revised 01 June 2026):

• Clarifies instructions for submitting quotes for a Firm Fixed-Price (FFP) contract.
• Emphasizes that quotes not meeting technical or delivery requirements will be deemed "Unacceptable."
• Lists required representations, certifications, and clauses (e.g., FAR 52.209-11, DFARS 252.204-7016).
• Requires active SAM.gov registration by the quote due date.
• Specifies submission format (email, Word, Excel, PDF; no ZIP files) and anonymization rules.
• Sets a deadline for questions (7 days prior to solicitation close date).
• Defines delivery terms as FOB Destination OCONUS to U.S. Embassy Kyiv, Ukraine, with delivery within 90 days after award.
• States that quoted prices must remain firm for 60 calendar days.
• Outlines submission requirements for the "Technically Approved Product," including:
  • Technical Specifications (product literature, data sheets, US/Designated Country manufacturing).
  • Capability Statement (POCs, delivery commitment, past performance, prime contractor affirmation or subcontractor details).
• Requires submission of CAGE code and identifying numbers for end products for SPRS assessment.

Addendum to 52.212-2 (Revised 01 June 2026):

• Details the evaluation criteria for quotes.

• Award will be based on "Lowest Price Technically Approved Product," incorporating SPRS risk assessments.

• Factor 1: Technically Approved Product: Evaluated on an Acceptable/Unacceptable basis for:

  • Technical Specifications (demonstrating compliance with Attachment 1, US/Designated Country manufacturing).
  • Capability Statement (active CAGE code, POCs, 90-day delivery to Kyiv, valid past performance, prime affirmation or subcontractor details).

• Factor 2: Supplier Performance Risk System (SPRS): Government will assess supplier and item price risk. Acceptable SPRS ratings include Green, Purple, Blue, Black, or "Unknown." Yellow, Red, or Grey are unacceptable.

• Factor 3: Lowest Price: Prices will be reviewed for completeness and reasonableness. Total Evaluated Price (TEP) will be calculated, excluding taxes. Unreasonably high or low prices based on SPRS risk analysis may lead to quote removal.

• Primarily affects sections related to quote submission instructions (52.212-1) and evaluation criteria (52.212-2).

• Bidders must ensure their submissions strictly adhere to the detailed technical specifications, capability statement requirements, and evaluation factors outlined in these addenda.

• Failure to comply with any subfactor in the evaluation criteria may result in disqualification.

Amendment / Modification

• Solicitation Closing Date Extended: The closing date for the solicitation (W564KV26QA026) has been extended from 05 June 2026 to 15 June 2026.

• New Clause Added: DFARS Clause 252.229-7001, "Tax Relief" (MAR 2020), has been incorporated. This clause outlines provisions for tax relief, specifically excluding certain taxes and duties from the contract price and detailing procedures for claiming tax relief in Germany.

• Clauses Deleted: The following FAR clauses have been deleted:

  • 52.228-3 Workers' Compensation Insurance (Defense Base Act)
  • 52.228-4 Workers' Compensation and War-Hazard Insurance Overseas.

• DFARS Clause Deleted: DFARS Clause 252.229-7002, "Customs Exemptions (Germany)" (MAY 1997), has been deleted.

• Attachments Updated: The list of contract documents, exhibits, or attachments has been modified. Specifically, the "Technical Specifications of Medical supplies (1)" (Document 0001), "W-14" (Document 0002), and "Addendum to 52.212-1 and Addendum to 52.212-2" (Document 0003) have been updated. Additionally, "OHDACA Q&A 2" (Document 0004) has been added.

• Solicitation closing date.

• Contract clauses (addition and deletion).

• List of contract documents, exhibits, or attachments.

• The deadline for submitting proposals or offers has been extended to 15 June 2026.

• Bidders should review the newly added "Tax Relief" clause and the updated list of attachments for any impact on their proposal preparation or understanding of contract terms.
