Terms and Conditions

This document outlines the contract terms and conditions applicable to the solicitation 70Z03826QB0000070 for DHS Acquisition of Commercial Items. It supersedes all other terms and conditions and acceptance of an order constitutes acceptance of these terms.

• 52.212-1 Instructions to Offerors: Offers must hold prices firm for 60 calendar days. Quotations require the "Requirement" document (Attachment 1) with completed unit prices.

• Evaluation Method: The solicitation is anticipated to be a Total Small Business Set-aside. Quotes will be evaluated based on Federal Acquisition Regulation (FAR) 13.106-2 criteria: lowest priced offer rated technically acceptable. Technical acceptability will be rated "acceptable" or "unacceptable" based on the offeror's ability to provide new manufactured commercial items from the Original Equipment Manufacturer (OEM) or an OEM-approved source, and exact part numbers must match the requirements schedule. Pricing will be evaluated for fairness and reasonableness, including any quantity or prompt payment discounts.

• Responsibility Matters (52.209-5, 52.209-7, 52.209-11): Offerors must certify they are not debarred, suspended, or proposed for debarment, and have not had certain convictions or delinquent federal taxes. They must also disclose information regarding responsibility matters and any unpaid federal tax liability or felony convictions.

• Security Prohibitions and Exclusions (52.240-90, 52.240-91): Includes provisions related to covered telecommunications equipment and services, business operations in Sudan, and Iran representation and certifications. Offerors must review SAM for excluded parties and represent compliance.

• Shipping Instructions: Deliverable items shall be shipped to the USCG Aviation Logistics Center at the provided address.

• Inspection and Acceptance: Performed at destination by local USCG personnel. Full and clear traceability must be provided with delivery of each part; otherwise, acceptance and invoicing may be denied. Certificates of Conformance (COC) and potentially Certificates of Airworthiness or PMA documentation are required.

• Deliveries/Performance: F.O.B. Destination is requested.

• Invoicing: Invoices to be submitted IAW FAR 52.212-4 to the designated billing office (USCG ALC Fiscal Branch) and are encouraged electronically. Payments will be made electronically IAW FAR 52.232-33.

• Option for Increased Quantity (52.217-6): The government may increase quantities for line items 1 and 2 within specified limits, exercisable by written notice within one year of award.

• Sustainable Products and Services (52.223-23): Requirements for sustainable products and services are detailed, referencing EPA and USDA programs.
