  • The Israeli Trade Act threshold is not met, so 52.225-3 and related clauses do not apply.
  • COTS (Commercial Off-The-Shelf) status does not exempt the Buy American clauses.
  • For COTS items, the "manufactured in the United States" prong remains, but the component test is waived. This means an offeror selling a domestically manufactured receptacle can certify it as a domestic end product without analyzing individual components (bolts, hinges, etc.).
  • Exception: This waiver does not apply to end products predominantly made of iron or steel. A steel trashcan requires affirmation of 95% domestic iron/steel content on the 225-2 certificate.
  • Offerors must use the DOI deviation versions of 52.225-1 and 52.225-2 and certify on the 225-2.

• Installation Clarification: Installation services are not part of this requirement.

• Attachment and Clause Incorporation: Attachment 4 is added, and FAR 52.240-90 is incorporated into the solicitation.
