Justification for Sole Source
This acquisition is conducted under FAR 13.106-1(b)(1), which permits sole source procurement for purchases not exceeding the simplified acquisition threshold when only one responsible source is reasonably available. SBIR is identified as the only vendor capable of fulfilling this requirement due to their unique knowledge, skills, and patents related to the emitter array technology and custom window integration. The government does not own the array package design and lacks the organic expertise for safe removal and replacement, making SBIR the sole viable option to prevent catastrophic loss or damage to critical equipment. The GWEF plans to develop internal procedures for window removal and installation to enable future competition.
