Requirement:
The Government requires the procurement of the MK 38 Decoupler Rubber Boot. Based on market research, the Government believes BAE Systems is the sole source capable of fulfilling this requirement. This determination is detailed in supporting Justification for Other Than Full and Open Competition (J&A).

Statutory Authority:
This procurement is conducted in accordance with Federal Acquisition Regulation (FAR) 6.302-1, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements," as implemented by FAR 13.106-1(b)(1).

This notice of intent is not a request for competitive proposals or quotations.

However, any interested party that believes it can meet the requirement may submit a capability statement. Responses to this notice must demonstrate clear and convincing evidence that competition would be advantageous to the Government.

The determination not to compete this proposed contract action is solely within the discretion of the Government. Information received will be considered for the purpose of determining whether to conduct a competitive solicitation for future requirements.

The Government will not be responsible for any costs incurred by interested parties in responding to this notice.
