Statement of Work (SOW) / Performance Work Statement (PWS)

To provide preventive maintenance, support, and emergency servicing for BD FACSLyric flow cytometers and BD Lyse/Wash Assistants (LWAs) at the National Institutes of Health (NIH) Center for Cellular Engineering (CCE).

• Service includes preventive maintenance, inspection, certification, and repair for two sets of BD FACSLyric flow cytometers and two sets of BD Lyse/Wash Assistants (LWAs).

• The LWAs are used to process licensed blood products and cellular therapy products before characterization by the FACSLyric flow cytometers.

• The instruments are critical for testing over 15,000 samples annually, supporting product licensing and release regulated by the FDA.

• One Preventive Maintenance Inspection per contract year.

• Provision of one PM Kit.

• Installation of software revisions released during the agreement term.

• Unlimited service visits, Monday-Friday, 8:00 AM to 5:00 PM.

• 24-hour guaranteed response for emergency on-site service, with a $500.00 credit issued if this commitment is not met.

• Unlimited telephone support for instruments, reagents, and applications.

• Location: 7th floor, building 10 at NIH.

• Contract Period:

  • Base Year: 04/01/2026 – 03/31/2027
  • Option Year 1: 04/01/2027 – 03/31/2028
  • Option Year 2: 04/01/2028 – 03/31/2029
  • Option Year 3: 04/01/2029 – 03/31/2030
  • Option Year 4: 04/01/2030 – 03/31/2031

• Contractor must provide all necessary personnel, supplies, materials, and services.

• Contractor is responsible for scheduling work with the principal user and coordinating through the COR.

• Contractor must determine and perform necessary decontamination of equipment.

• Contractor must comply with laboratory practices, policies, and safety precautions, providing any required personal protective equipment.

• Services are to be performed during normal working hours (8:00 AM - 5:00 PM, Monday-Friday), excluding Federal Holidays, unless approved by the COR.

• All labor and travel costs are to be included at no additional cost to the government.

• IT Security requirements are detailed in a separate IT Security Form.

This document is a Notice of Intent (NOI) to award a sole source contract. It is not a request for quotation, and a solicitation document will not be issued. The government intends to procure a five-year service contract for specific BD BIOSCIENCES equipment.

• Two sets of Universal Loaders (S/N: Z662462000213, Z662462000214)
• Two sets of BD Lyse/Wash Assistants (LWAs) (S/N: RR337146001216, RR337146001208)

These instruments are used for processing patient samples (licensed blood products, cellular therapy products) and identifying cell populations for clinical research and cell therapeutic product development. They also aid in testing gene modification efficiencies and quality control of cell selection methods.

BD Biosciences is identified as the sole vendor capable of providing periodic Preventive Maintenance (PM) for the specified devices.

This acquisition will follow FAR Part 13 – Simplified Acquisition Procedures, specifically Subpart 13.106-1(b)(1), which allows for soliciting from one source when only one source is reasonably available. This approach exempts the acquisition from FAR Part 6 – Competition Requirements.
