Justification & Authority
The Contracting Officer determined that Sardi's Catering, Inc. is the incumbent and possesses the unique capability to continue these critical services without interruption, thereby preventing unacceptable delays and mission degradation. The authority for this sole source procurement is 41 U.S.C. §1901(c)(3) and §1903(b)(3), as implemented by FAR 12.102(b), for commercial services directly supporting an emergency operation by Executive Order. Simplified procedures under FAR Part 12 will be utilized.
