Statement of Work (SOW) / Performance Work Statement (PWS)

This Statement of Work (SOW) outlines the requirements for ongoing maintenance and support services for various software modules used by the National Institutes of Health (NIH) Clinical Center. The primary goal is to ensure the reliable operation and continuous support of critical laboratory information systems.

The vendor shall provide comprehensive maintenance and support for the following Soft Computer Corporation (SCC) software modules:

• SoftPathDx: Anatomic pathology and cytology data capture, reporting, and workflow system.
• SoftBank: Blood bank and transfusion service management system.
• SoftLAB: Computerized laboratory data processing and management system.
• SoftMic: Microbiology specimen processing and reporting system.
• SoftTotalQC: Quality control and inventory management for clinical laboratories.
• SoftReports: Enhanced reporting capabilities.
• SoftWebPlus: Physician/provider order entry and result query solution.
• SoftMedia: Document and image storage for clinical services.
• SoftID: Patient and specimen identification system.
• SoftID.Tx: Transfusion data management system.
• SoftFlowCytometry: Flow cytometry analysis and reporting.
• SoftBI: Data analytics and visualization for clinical laboratories.
• SoftBiobank: Biorepository management system.
• SoftMolecular: Molecular testing data management and reporting.

Services include background monitoring, problem diagnosis, system stabilization, 24/7 operational support, OEM hardware support (IBM), Oracle and DB_Vista database administration, and maintenance of existing and new interfaces (HL7 compliant).

• Availability: Maintain a system availability level of at least 99.5%.

• Response Times:

  • Production System Problem (patient safety at risk, system down): 1-hour phone response, 2-hour fix, 4-hour on-site resolution.
  • Production System Problem (major portions usable): 1-hour phone response, 4-hour fix, 24-hour on-site resolution.
  • Production System Problem (system usable with workaround): 1-hour phone response, 48-hour fix.
  • Non-production System Problem: 4-hour response, 48-hour fix.

• Effectiveness Level: Defined as (Productive Operation Use Time) / (Productive Operational Use Time + Functional Failure Downtime) * 100.

• Maintenance Period: Five (12-month) periods, exercisable at the Government's discretion.

• Period of Performance: Base Year (Oct 1, 2024 - Sep 30, 2025) with four option years extending through Sep 30, 2029.

• Location: Services to be performed at the NIH Clinical Center, Bethesda, Maryland.

• Staffing: Services must be performed by fully trained and technically experienced personnel. OEM certification may be required.

• Compliance: Adherence to Electronic and Information Technology Accessibility Standards (36 CFR Part 1194) including Section 508.

• Licensing: A non-exclusive, irrevocable, perpetual license to use software, including custom developments.

• Parts: Only new standard parts or equivalent meeting OEM specifications.

• Authorization: Offeror must provide Letters of Authorization (LOA) for Soft Computer software operations, maintenance, and resale.

• HIPAA: Conformance to mandatory rules, including HIPAA compliance where applicable.

Notice of Intent to Sole Source

This document is a Notice of Intent (NOI) to award a sole-source contract to Soft Computer Corporation (SCC). It is not a request for quotation, and a solicitation document will not be issued. The procurement aims to continue obtaining software and hardware license and maintenance services for SCC's proprietary Laboratory Information System (LIS) software, which runs on IBM hardware and the AIX operating system.

• SCC's LIS software is proprietary, and they are the incumbent provider.

• SCC does not permit third-party maintenance or release source code.

• The LIS is mission-critical for the Clinical Center, supporting patient diagnosis and care.

• Uninterrupted operation is imperative for patient safety, making SCC the only source capable of providing necessary maintenance, including source code revisions.

• The procurement is being conducted under FAR Part 13 – Simplified Acquisition Procedures, Subpart 13.106-1(b)(1), as only one source is deemed reasonably available.
