Justification for Sole Source

The award to BAE Systems was justified due to:

  • Proprietary Data: BAE Systems is the original designer and developer, retaining the Technical Data Package (TDP), which the Navy did not procure.
  • Unique Capability: BAE Systems is the only known manufacturer possessing the unique knowledge, experience, and special skills required.
  • Cost & Delay Avoidance: Awarding to another source would lead to substantial cost duplication and unacceptable delays (estimated 24 months for prototype qualification and another 24 months for production units), impacting new ship production lines and potentially incurring government liability.
  • TDP Unavailability: BAE Systems has declined to sell the TDP.

Efforts to Solicit Other Offers

A market survey indicated no other industry sources could provide similar products. A Request for Information/Sources Sought Requirement was posted on SAM.gov, but no responses were received.

Future Competition

NAVAIR currently has no plans to compete future contracts for this system. However, if another potential source emerges, competition will be assessed.
