Attachment / Provisions and Clauses

This document, Attachment J-4, provides the Department of Defense (DoD) Required Provisions and Clauses for Task Orders issued under a Master Contract. It serves to inform potential bidders about the specific regulatory and contractual requirements that will apply to task orders under this master agreement.

This document lists numerous DFARS (Defense Federal Acquisition Regulation Supplement) provisions and clauses that are incorporated by reference. These cover a wide range of requirements, including but not limited to:

• Representations and Certifications: Such as those related to compensation of former DoD officials, foreign government ownership or control, organizational conflicts of interest, and annual representations and certifications via SAM.gov.
• Contract Performance and Compliance: Including requirements for safeguarding covered defense information, trade agreements, Buy American Act, reporting of performance outside the U.S. and Canada, and cost estimating system requirements.
• Personnel and Operations: Provisions related to contractor personnel supporting U.S. Armed Forces deployed outside the U.S., including definitions of CAAF and non-CAAF, security, medical care, legal compliance, and personnel requirements.
• Specific DoD Requirements: Such as antiterrorism/force protection policies, small business subcontracting plans, and warranty tracking of serialized items.

FAR 52.215-8 Order of Precedence-Uniform Contract Format is applicable. In case of conflict between task order terms and Master Contract terms, the Master Contract terms take precedence.

Certain provisions, such as DFARS 252.219-7003 (Small Business Subcontracting Plan) and DFARS 252.222-7000 (Restrictions on Employment of Personnel), are provided in full text, detailing specific requirements for offerors and contractors.
