Evaluation
The Government intends to procure these items under the statutory authority of Title 10, U.S.C. Section 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1, "Only one responsible source." D2 Incorporated is identified as the design activity and Original Equipment Manufacturer (OEM) for these particle counters, possessing the necessary technical data. Responses received within fifteen (15) days of publication will be considered solely for the purpose of determining whether to conduct a competitive procurement. The decision to not open the requirement to competition remains at the Government's discretion.
