Sources Sought Notice

This notice is a Sources Sought, not a Request for Quote. Its purpose is to conduct market research to determine compliance with the Buy Indian Act and to decide on a potential set-aside for Indian Economic Enterprises (IEE) or Indian Small Business Economic Enterprises (ISBEE).

The government is seeking information on contractors capable of providing a temporary, safe, and clean ADA-compliant restroom trailer.

The contracting officer will prioritize purchases for IEEs. Acquisitions subject to commercial items or simplified acquisition procedures must be set-aside exclusively for ISBEEs, to the maximum extent possible.

• Indian Economic Enterprise (IEE): A business owned by one or more Indians, Federally Recognized Indian Tribes, or Alaska Native Corporations, where ownership and earnings are at least 51% Native American, and management/operations are controlled by one or more Indians.
• Indian Small Business Economic Enterprise (ISBEE): An IEE that also qualifies as a small business concern per 13 CFR Part 121.

Firms interested in this requirement must provide the following in writing:

• Company name

• Point of contact details (name, title, phone, email)

• FSS / SEWP Contract number (if applicable)

• DUNS number or SAM Unique Entity Identifier

• Tax ID number

• Indication of business category (IEE or ISBEE) qualification

• A capability statement detailing qualifications and ability to meet the requirement.

• Representation must be made on the attached IHS Indian Economic Enterprise Representation form.

• Identification of the Federally Recognized Indian Tribe or Alaska Native Corporation relied upon for IEE status.

Prospective contractors must be registered in the System for Award Management (SAM) and complete electronic annual representations and certifications.

It serves as a self-certification for offerors to confirm they meet the definition of an "Indian Economic Enterprise" as required by the Buy Indian Act. This form is to be submitted in response to a Sources Sought Notice, Request for Information (RFI), or Solicitation.

• Eligibility Requirements: The enterprise must meet the definition of an "Indian Economic Enterprise" at the time of offer, contract award, and throughout the contract performance period. Failure to meet these requirements necessitates immediate written notification to the Contracting Officer.
• Representation: Offerors must indicate whether they do or do not meet the definition of an "Indian Economic Enterprise" with "Indian Ownership."

  • Name of Federally Recognized Tribal Entity
  • Name of the 51% owner of IEE Firm
  • Business Name
  • DUNS Number
  • Certifying Signature
  • Print Name

This form is crucial for bidders responding to opportunities that have a Buy Indian Act set-aside or preference. Bidders must accurately complete this form to self-certify their eligibility. The contracting officer may require further documentation, and false information can lead to penalties. Successful offerors must also be registered in the System of Award Management (SAM).
