Justification
The procurement is justified under FAR 13.106-3 and FAR 6.302-1(b)(ii), as well as FAR 8.405-6(b)(1) and FAR 16.505(b)(2)(i)(B), due to the proprietary nature of the Pivotal Vision software. NV5 Geospatial Solutions Inc. is the sole original equipment manufacturer (OEM) capable of providing the necessary support. Market research indicates that transitioning to an alternative solution would be disadvantageous and not cost-effective given existing investments.

A determination not to compete this proposed contract is solely at the government's discretion. The government is seeking a discount from the offeror's schedule prices pursuant to FAR 8.404(d).
