THIS IS A PROJECT LABOR AGREEMENT (PLA) SURVEY ONLY. THIS IS NOT A REQUEST FOR PROPOSAL, REQUEST FOR QUOTE, OR INVITATION FOR BID. THERE WILL NOT BE A SOLICITATION, SPECIFICATIONS OR DRAWINGS AVAILABLE AT THIS TIME.

This is a SPECIAL NOTICE. No proposals are being requested or accepted with this notice. The U.S. Army Corps of Engineers (USACE) Seattle District is soliciting comments from the construction community addressing the potential use of PLA for a large-scale construction project (exceeding $35 million, per FAR 22.502) at Camp Pendleton, CA.

DESCRIPTION OF WORK:

Repair, renovate, and install equipment in 140,000 sq ft warehouse and renovate approximately 19,000 sq ft of administrative facilities located at the Camp Pendleton Marine Base San Onofre Nuclear Generating Station (SONGS), in San Diego County, California.

The general scope includes installing warehouse support equipment, replacing associated utility infrastructure, revamping truck receiving/transportation flow, and replacing standing seam metal roofs. The construction performance period is estimated at 18 months with a targeted award in late fiscal year 2026.

The specific scope includes, but is not limited to:

  1. Remodeling the admin facilities to include all interior finishings, bathrooms, utilities, windows, and ADA doors. 
  2. Remove/replace all existing items within the warehouses (lighting, pallet racks, fire alarm, electrical).
  3. Repair/level and diamond polish concrete slabs, concrete joints, interior support structure, and paint walls and remove/replace warehouse siding.
  4. Install warehouse items (i.e., electrical service, CCTV camaras, warehouse equipment and pallet racking, forklift battery charging stations, and HVAC)
  5. Install traffic control and monitoring systems (proximity sensors and CCTV intersection camera, powered entry/exit gates, Radiation Detection Monitor, and over-head canopy structure)
  6. Add and repair pavements and security fencing.
  7. Construct 360 sq ft scale house.

MAGNITUDE:

In accordance with DFARS 236.204, the magnitude of the estimated cost of construction (ECC) range for this project is between $25,000,000 and $100,000,000.

FACTORS TO BE CONSIDERED:

Some of the factors that may be considered regarding PLA use are:

  1. The project will require multiple construction contractors and/or subcontractors employing workers in multiple crafts or trades.
  2. There is a shortage of skilled labor in the region in which the construction project will be sited.
  3. Completion of the project will require an extended period of time.
  4. PLAs have been used on comparable projects undertaken by Federal, State, municipal, or private entities in the geographic area of the project.
  5. A PLA will promote the agency’s long term program interests, such as facilitating the training of a skilled workforce to meet the agency’s future construction needs.
  6. Any other factors that the agency decides are appropriate.

EO 14063, Use of Project Labor Agreements for Federal Construction Projects, issued 04 February 2022, provides that it shall be the policy of the Federal Government to use PLAs in connection with large-scale construction projects to promote economy and efficiency in Federal procurement.

FEDERAL ACQUISITION REGULATIONS (FAR) 22.502 - DEFINITIONS:

Large-scale construction project means a Federal construction project within the United States for which the total estimated cost of the construction contract to the Federal Government is $35 million or more.

Project labor agreement means a pre-hire collective bargaining agreement with one or more labor organizations that establishes the terms and conditions of employment for a specific construction project and is an agreement described in 29 U. S.C. 158(f).

FAR 22.503 – POLICY:

(a) Executive Order (E.O.) 14063, Use of Project Labor Agreements for Federal Construction Projects, requires agencies to use project labor agreements in large-scale construction projects to promote economy and efficiency in the administration and completion of Federal construction projects.

(b) When awarding a contract in connection with a large-scale construction project (see 22.502), agencies shall require use of project labor agreements for contractors and subcontractors engaged in construction on the project, unless an exception at 22.504(d) applies.

INDUSTRY COMMENTS:

The construction community is invited to comment on the use of a PLA by answering the following questions:

  1. If a PLA requirement is included in the solicitation, will your company submit a bid/proposal? 
  2. If a PLA requirement is not included in the solicitation, will your company submit a bid/proposal?
  3. To your knowledge, have projects of this kind been done in the last 5 years in the local area? If so, please elaborate to the best of your ability, including the information below, and provide supporting documentation where possible.
    1. Project Name and Location
    2. Detailed Project Description
    3. Approximate time of construction
    4. Initial Cost Estimate vs. Actual Final Cost
    5. Was the project completed on time?
    6. Number of craft trades present on the project
    7. Was a PLA used?
    8. Were there any challenges experienced during the project?
  4. Are you aware of skilled labor shortages in the area for those crafts that will be needed to complete the referenced project? If so, please elaborate and provide supporting documentation where possible.
  5. Are you aware of any projects anticipated in 2026 - 2028 that could limit the available pool of skilled labor required for this project? If so, please elaborate and provide supporting documentation where possible.
  6. Are you aware of time sensitive issues/scheduling requirements that would affect the rate at which the referenced project should be completed?  If so, please elaborate and provide supporting documentation where possible.
  7. Identify specific reasons why or how you believe a PLA would advance the Federal Government’s interest in achieving economy and efficiency in Federal procurement.
  8. Identify specific reasons why you do not believe a PLA would advance the Federal Government’s interest in achieving economy and efficiency in Federal procurement.
  9. Identify any additional information you believe the Government should take into consideration regarding the use of a PLA on the referenced project.
  10. What are the likely cost impacts, if any, to your bid/proposal price if a PLA requirement is included in the solicitation?  Please provide as much detail as possible regarding any anticipated cost impacts (positive or negative) of the inclusion of a PLA requirement, including any information you can provide about the magnitude of the anticipated impact.
