Justification for Other Than Full and Open Competition

• A Sources Sought Notice was posted, with only one response received from EOS-AV, which did not fully meet the requirements or provide evidence of OEM sourcing.

• This justification is for other than full and open competition, citing 10 U.S.C. § 3204(c) and FAR 6.302-1 (Only one responsible source).

• The Buy American Act clause (52.225-1) will apply.

• The USCG does not own the rights to the initial system acquisitions for the HC-144 and lacks the proprietary technical data required for full and open competition.

• The agency will continue market research and investigate the feasibility of purchasing technical data from the OEM to potentially foster future competition.
